Challenges and conditions to advance towards energy justice in Mexico

This blog entry accompanies the launch of the first ever Benchmark on Renewable Energy and Human Rights. It was originally published by the Business & Human Rights Information Centre. By Rosa Peña Lizarazo and Astrid Puentes Riaño The climate crisis, in the words of Michelle Bachelet, the UN High Commissioner for Human Rights, is the greatest current threat to human rights, and one that requires urgent political decisions and collective action. One such decision concerns progress in the energy transition, that is, the shift from the use of energy derived from fossil fuels to the use of energy that is renewable and less emission-intensive. By reducing greenhouse gas emissions, this transition would help to address the climate crisis and improve air quality. In Mexico, this transition has motivated multi-sector debates and requires a participatory, inclusive, and transparent dialogue with a human rights approach and a territorial perspective. There are four main challenges to this: main challenges 1. The socioeconomic context Mexico has some of the highest levels of inequality on the planet, with ten of the country’s richest people holding wealth the equivalent to 50% of its poorest. Understanding this context is key to adapting energy transition policies that meet international climate obligations without creating more inequity. It is also essential to learn from the past. The 2013 energy reform set in motion a model for the massive implementation of renewable energy projects, both large-scale and private. This made it impossible to overcome the wide gaps in exclusion for socio-economic and territorial reasons. 2. Energy consensus Another challenge is achieving regulatory and social consensus on what clean and renewable energy is and what the goal should be in its implementation. Despite the proposals of some environmental organizations, the Mexican Government accepted vague and more convenient definitions to fulfill its climate commitments.  It defined clean energies as those that do not generate polluting emissions during their production, ignoring whether they can generate other negative impacts on the environment. 3. Respect and protection of human rights The generation of energy from fossil fuels has violated human rights, provoking scenarios of exclusion and serious implications for Mexico’s indigenous and rural communities. Likewise, many non-conventional renewable energy projects, like those developments in the Isthmus of Tehuantepec or in the Yucatan Peninsula, have generated new socio-environmental conflicts. These relate to the lack of transparency and participation, violation of the rights of native peoples, lack of knowledge of traditional ownership and uses of land, obstacles to access natural resources, and environmental degradation. It is therefore a challenge to undertake a transition that considers and prevents these harms from a human rights perspective. 4. Energy diversification and reliability Given current dependence on fossil fuels in the energy grid - which by 2018 generated 75.88% of the country's energy - progress towards mitigation and adaptation to climate change requires a process of diversification of energy sources that takes advantage of Mexico's potential to develop renewable energy. Another associated challenge is to guarantee the reliability of the system to ensure it can continuously meet the country's energy demand. how can a fair transition come about? At AIDA, we believe this can be done by building energy justice in Mexico, through the following: Adapting to the socioeconomic context: Betting on a transition that becomes an engine of local development, through for example, the generation of jobs, the democratization of energy and energy generation in the scale necessary for self-supply. This requires overcoming existing barriers to exclusion by implementing, for example, community energy projects. Designing participatory energy policy: Propose scenarios of effective and inclusive participation in order to agree on the minimum aspects of the goals of energy policy in the country, in response to the climate crisis. Compliance with environmental and human rights standards: Advisory Opinion 23 of the Inter-American Court of Human Rights highlights that any policy or project must guarantee access rights in environmental matters and labour rights, comply with the principles of prevention and precaution, respect the rights of indigenous and Afro-Mexican peoples, and have a gender perspective. Diversification of the energy grid: Promote financing mechanisms that encourage clean technological innovation and investment in decentralized renewable energies and with better storage strategies. Without a doubt, a just energy transition is necessary and urgent in Mexico. The country now has the opportunity to undertake a progressive and timely transition that allows for better scenarios of social, environmental and climate justice, and that responds to current social demands.

Mexico’s Federal Mining Law threatens human rights of indigenous peoples

International civil society organizations submitted amicus curiae briefs to the Mexican Supreme Court in support of the State of Puebla-based Masewal people’s constitutional action.Groups also delivered to the Court’s Second Chamber more than 4,000 signatures supporting the defense of indigenous people’s rights, collected through www.change.org.mx International civil society organizations are supporting a lawsuit filed by the Masewal indigenous people of Cuetzalan del Progreso, based in the Sierra Norte of the Mexican state of Puebla, against Mexico’s Mining Law. The Masewal request that the Supreme Court of Justice of the Nation (SCJN) declare the law unconstitutional because it violates indigenous peoples’ fundamental rights. Earthjustice, the Environmental Defender Law Center (EDLC) and the Interamerican Association for Environmental Defense (AIDA) filed separate amicus curiae (“friend of the court”) briefs to provide information in order to help the SCJN rule on litigation initiated by the Altepetajpianij Maseual Council and the Mexican Center for Environmental Law (CEMDA). The constitutional suit, originally filed in March 2015, argues that Mexico adopted the new Mining Law in violation of indigenous rights by not previously consulting or informing indigenous peoples before passing the law. As a result, the law failed to take into account indigenous values or perspectives and contained no mechanism to protect their human rights, even though many mining concessions already affect their territories. Above all, this law violates indigenous peoples’ rights to self-determination by excluding them from decision-making on mining within their territories, thus threatening local communities’ quality of life. “As the First Peoples, we are convinced that, in order to have a good life –Yeknemilis, as we say in Nahuatl– it is necessary that we be well and have social peace. And we cannot be well, nor can we build social peace in our territories, when extractive projects such as destructive mining threaten our way of life,” the Masewal people told SCJN justices in their brief. “Our contribution presented in our amicus brief highlights that Mexico’s international obligations require free, prior, and informed consultations with indigenous peoples before approving any legislative measure that affects them, especially when it comes to their territorial rights,” said Guillermo Zúñiga, Earthjustice international attorney.  “This also includes laws on the extraction of natural resources found in their territories, which applies directly to the case of the Mining Law.” “Mining concessions cannot be granted solely based on mining legislation. A higher-level legal framework, based on human rights and environmental law, and on the interrelation between the two issues, is must be applied in this case. This broader, legal framework determines and limits the granting of mining titles in the case of lands and territories,” says EDLC in its amicus’ conclusions. "Mexico’s Supreme Court of Justice of the Nation has the opportunity to set an exemplary precedent for the region with respect to the protection of indigenous rights," said attorney Carlos Lozano Acosta of AIDA. "In turn, the SCJN can learn from regional experience, adopting the relevant standards that courts in other countries have provided in favor of indigenous peoples, as evidenced in our amicus brief." Contamination and COVID-19: Why didn't air quality Improve in the Valley of Mexico?

Measures adopted to deal with the global health pandemic caused by COVID-19 have led to a reduction in some atmospheric pollutants, which has considerably improved air quality in various cities around the world. Yet in the metropolitan area of the Valley of Mexico (MCMA)—which includes Mexico City and surrounding towns—air quality has not improved despite the suspension of activities associated with sources of pollution like traffic and industry. Months before the health emergency was declared in late March 2020, the air quality reported by the Valley’s Atmospheric Monitoring System was in the range of "regular" to "bad," due primarily to vehicle congestion. With restrictions on mobility established due to the pandemic, vehicle traffic decreased by up to 70% and, with it, so did some of the air pollution. According to official information, distancing measures caused a reduction in carbon monoxide and nitrogen oxides—of 58 and 32 percent, respectively. However, tropospheric ozone (O3), one of the most damaging pollutants to air quality and human health, did not decrease significantly (only 3 or 4 percent, according to official data). That’s why, in May, two months after measures were adopted to address the health crisis, air quality in the Valley of Mexico remained at the same parameters as the beginning of the year—that is, ranging from "regular" to "bad," according to the Atmospheric Monitoring System. The question that arises, then, is WHY? What causes air pollution? Various gases and compounds contaminate the air. Primary pollutants—like carbon dioxide (CO2), nitrogen oxides (NOx) and volatile organic compounds (VOC)—are directly discharged into the atmosphere. Secondary pollutants, like tropospheric ozone (O3), form in the atmosphere as a result of the chemical transformation of those primary pollutants. Tropospheric ozone is formed from the interaction of sunlight with "precursor gases," including volatile organic compounds and nitrogen oxides. Now, there are three factors that actually affect air quality: weather conditions, topography, and concentrations of one or more pollutants at levels that can harm the environment and human health. These concentrations are measured by official monitoring systems, like the MCMA Atmospheric Monitoring System. The World Health Organization establishes concentration levels of pollutants that should not be exceeded over a specific period. For tropospheric ozone, the recommended value is 50 parts per billion (ppb) over an eight-hour average. But Mexican regulations are more lax and establish a lower limit for this compound: a concentration less than or equal to 95 ppb on an hourly average (that is, in a 60-minute time interval). In addition, to activate an environmental contingency for ozone, concentrations must be greater than 154 ppb (hourly average). This standard implies less protection for the population's health. At the beginning of this year, the hourly ozone concentration in the Valley of Mexico averaged only 23 ppb, but it has risen since then. Despite the restrictions resulting from the health crisis, the average hourly concentration of ozone was 41 ppb in April and 45 ppb in May. Also, from January to May, 99 days were recorded in which ozone concentrations exceeded the 95 ppb limit. Why did concentrations of ozone increase? The restriction on mobility during the health contingency was not adequate to decrease concentrations of ozone in the atmosphere for two reasons: first, the sources of this compound are not limited to the use of vehicles; and second, the period of social isolation coincided with the so-called ozone season, a time of the year when the concentrations rise due to the increase of solar radiation and the decrease of rain and wind. As previously mentioned, tropospheric ozone is formed by the interaction of sunlight with precursor gases. Among these gases are nitrogen oxides—mainly generated by the combustion processes of automobiles, especially diesel engines—and volatile organic compounds, which arise from more diverse sources: the use of solvents, leaks of liquefied petroleum gas in heaters and stoves, cosmetic and cleaning products, and evaporated fuel in gas stations and automobiles without evaporative emissions control. According to official data, during social isolation, volatile organic compounds were only reduced by 15 percent, including all their emission sources. On the other hand are forest fires, a major source of ozone precursor gases. From January 1 to May 3 of this year, in Mexico City alone there were 644 forest fires— lower in number compared to the same period in 2019, but equally as intense. As for the ozone season, which begins the last week of February and ends with the first rains in June, the average temperature in the Valley of Mexico was higher this year. In April, it was 2°C higher than the average recorded in the same month between 1981 and 2010—the hottest April in recorded history. Because the temperature is directly related to solar radiation and lack of wind, its increase explains the higher ozone concentrations. The sum of these factors contributed to the fact that ozone concentrations actually increased despite the restrictions established by the pandemic. This, in turn, led to the residents of the Valley of Mexico continuing to experience poor air quality and suffering its negative health impacts. Why reducing ozone is good for public health and the climate Ozone not only affects air quality and thus public health. It also has the ability to absorb sunlight and heat the atmosphere, meaning it is a  short-lived climate pollutant (SLCP). Because its emissions aggravate the climate crisis, more than 11,000 scientists from around the world have highlighted the need to reduce SLCPs in order to rapidly combat global warming. The intensity of the forest fires and the particularly high temperatures of this year's “ozone season” demonstrate the effects of the climate crisis that we are failing to adequately confront. That’s why it’s imperative that the government implement actions to reduce emissions of precursors gases—not only during the health emergency, but also when we get through it, when motorized transportation (a source of nitrogen oxides) is reactivated. Improved controls on the type of cars on the road, based on their polluting potential, and personal choices like biking, also recommended to reduce the risks of contagion, would help to achieve this objective, reduce global warming, and improve the health of those living in the Valley of Mexico. In addition, society must commit to measures of regulation, communication and education that curb consumer habits and improve on the production and distribution of goods and services that continue to emit volatile organic compounds (another ozone precursor) on a daily basis. Restricting the production and use of aerosol products, as well as repairing and preventing leaks of liquefied petroleum gas, would help to reduce these emissions. Finally, it’s necessary to strengthen the country's weak environmental policy and combat non-compliance with environmental health standards, which has resulted in an insufficient reduction in air pollution. Mexican air quality standards must be updated to set stricter limits that are compatible with international standards and the protection of the human right to health. The above are just some examples of actions that authorities and society can take to show that we have learned a lesson and will do what is necessary to improve air quality and face possible new health crises, as well as to combat the climate crisis that threatens to end the world as we know it today.

What I learned from my internship at AIDA

Last year, I completed a three-month internship with AIDA in La Paz, the capital of Baja California Sur, Mexico. It was part of the academic process to become a lawyer in Germany, my home country. The internship allowed me to combine my professional training with my passion for nature, as well as to gain experience working with an international NGO in the field of environmental law. I applied to the internship with AIDA's Marine Biodiversity and Coastal Protection Program without specifying a preferred location. Imagine my delight to learn that the internship would take place in La Paz, Mexico, a small city surrounded by nature. Coming from one of the most densely populated countries in the world, it was amazing to live in a place with so much space. I was fascinated by the diversity of ecosystems in the area: deserts, mangroves, mountainous pine forests, and the rock and coral reefs of the Gulf of California.  On my first weekend, I was able to take in the abundance of wildlife in La Paz when Camilo Thompson, AIDA attorney and my supervisor, and Mario del Angel, his neighbor and a kayak guide, took me on a tour of the El Mogote wetlands, an ecosystem of international importance. I was impressed to see, in the first light of day, a group of dolphins in the bay. The morning was complete when I had my first chilaquiles, a typical Mexican dish, for breakfast. As we toured the waterways taking pictures of herons among the mangroves, I learned about the importance of coastal wetlands—they serve as habitat for key species and are natural carbon sinks. From the beginning of my internship, I participated in the virtual meetings of AIDA’s marine team, distributed throughout several countries of the region. I learned about the variety of animals and ecosystems that AIDA works to protect. From the office in La Paz, our contribution was focused on Mexico. I learned about national regulations related to reefs, herbivorous fish, and Natural Protected Areas. I supported research on the state of protection of these fish, which are essential for keeping Latin American and global coral reefs healthy. The combination of direct contact with nature and working in the office for local and regional projects gave me a different perspective on the nature of environmental law, and increased my motivation to learn. I learned that AIDA has worked for years with other organizations, local stakeholders, and scientists to protect fisheries and endangered species such as whales and sea turtles. One of the most enriching aspects of my internship was being able to experience first-hand the natural wealth that AIDA seeks to preserve. Though I’d been a diver for many years, I never ceased to be amazed by the sight of sea lions, bull and hammerhead sharks, killer whales, rays, sea turtles, and countless species of reef fish in their natural habitat. While in La Paz, I finished my rescue diver course and accompanied a team of marine biologists to conduct a visual census of marine life on Espiritu Santo Island. On four occasions, I visited Cabo Pulmo National Park, the largest coral reserve in the Gulf of California. I went diving and snorkeling. I participated in meetings of the Cabo Pulmo Vivo coalition, dedicated to protecting the park and its area of influence. It was gratifying to know that I was doing my small part for the site’s conservation. The internship gave my professional training a multidisciplinary approach. La Paz is one of the scientific centers of marine biology in Mexico and, while there, I was able to exchange ideas with marine biologists on diving trips and while socializing in  bars in the city. Around La Paz, I was also able to spend time bird watching, one of my hobbies. The state of Baja California Sur is home to roughly 432 species of birds. I was able to see a wide variety of migratory species, as well five of the six endemic ones. I completed the internship very grateful for the experiences I had gained. Now, I’m back in Berlin, but I plan to return soon to La Paz to see the birds, whale sharks, and other majestic species that inhabit the area and are living proof of the valuable work of organizations like AIDA.

Defend Yum Balam, a key ecosystem for biodiversity and the climate

AIDA presented an amicus brief demonstrating the importance of the protected area, as well as Mexico’s international environmental and human rights obligations to preserve it in the face of a 21,000-room hotel project that would imply significant damage to the site. Cancun, Mexico. The Interamerican Association for Environmental Defense (AIDA) presented a legal brief (Amicus Curiae) before the Seventh District Court of the State of Quintana Roo to defend the Yum Balam Flora and Fauna Protection Area, located in the north of the state. In 2018, when the site's Management Program was published, private and communal landowners filed several lawsuits against the program and the decree that created the protected area, arguing that it affected their rights to participation, property, and legality. Prior to the publication of the Management Program, the Advisory Council of the protected area received a report from a consultant who recommended the construction within Yum Balam of a mega tourism project that includes 21,000 hotel rooms, deeming it economically viable. "That viability is in doubt because each hotel room would generate changes in land use, population growth, loss of flora and fauna, and other irreversible damages to the ecological characteristics of the place," said Camilo Thompson, AIDA attorney. "What is at stake is Yum Balam’s contribution to the enjoyment of a healthy environment for present and future generations." The decree creating the protected area, which dates back to 1994, puts the public interest and regulation of natural environments that benefit the entire country above private interests. The Management Program is aimed at regulating the conservation and sustainable use of Yum Balam. The site is considered a Priority Wetland of International Importance under the Ramsar Convention. "According to a study, Yum Balam's mangroves and sea grasses prevent 38.5 million tons of carbon dioxide from escaping, equivalent to the greenhouse gas emissions of 9.4 million Mexican people," said Pilar Diez, Regional Director of the Mexican Center for Environmental Law (CEMDA-Southeast). In its 152 thousand hectares, the site also has reefs and coastal dunes. It is home to more than 90 percent of the endemic birds of the Yucatan Peninsula, sea turtles with special protection status, whale sharks, dolphins, and endangered terrestrial species like the jaguar. In fact, in the Maya language, Yum Balam means Señor Jaguar. "Our brief seeks to document the national and international importance of Yum Balam in the context of the climate crisis," Thompson added. "Betting on the development of tourism megaprojects is incompatible with the urgent task of confronting this crisis and achieving climate justice.” Both the United Nations Intergovernmental Panel on Climate Change (IPCC) and the Intergovernmental Platform for Science and Policy on Biodiversity and Ecosystem Services (IPBES) have been very firm about the current situation of ecosystem loss and the urgent actions that all countries must take in the face of the climate crisis. "We’ve documented the international legal framework under which the Mexican State is obliged to guarantee fundamental human rights, such as the right to a healthy environment," Thompson explained. "Mexico has the obligation to conserve its biodiversity, including coastal wetlands, forests, jungles and other ecosystems that regulate the climate and contribute to fishing and tourism." Clean air and climate justice: the best gifts for our children

Today Mexico celebrates Children’s Day. The best gift we can give to millions of boy and girls is clean air and climate justice. It’s the only thing I want to give to my children that, sadly, I can’t, at least not this year. Mexico City, where we live, has had bad air quality 112 of the 120 days of 2019, thus far.  Those of us who live in this city have suffered from contamination, particularly over the last month; three “environmental contingencies” (air pollution alerts) for ozone were declared for a total of seven days.  In recent years, contingencies have occurred during peak ozone season—February 15 to June 15—a period in which tropospheric ozone (present in the air we breathe) exceed the maximum levels allowed by Official Mexican Law. This gas, present throughout the year, rises when the burning of fossil fuels by vehicles and industries is compounded by changing weather conditions: less rain and winds, and more solar radiation. This prevents the air pollution that we produce from dispersing into nearby areas. Increased ozone causes serious damages to the environment and public health, particularly to children. According to the Pan American Health Organization, ozone in the air can affect lung function, making breathing difficult. Thus, the group most vulnerable to contamination also includes people with respiratory diseases, older adults and athletes. Authorities recommend that the people, particularly vulnerable groups, abstain from outdoor activities during the contingencies, particularly between 1:00 and 7:00 p.m. Other measures include increasing vehicle restrictions and reducing the consumption of liquefied petroleum gas. Despite its harsh realities, ozone season is not a new or surprising phenomenon, nor is it normal. It shouldn’t be normal for parents to resign ourselves to its presence, to birthday parties indoors and not letting our children go to the park with their friends.  I understand the impossibility of controlling the rain, sun and wind; but ozone is another story. There are clear measures that could and should have been implemented years ago to prevent the ozone season from being unavoidable in Mexico City. Already fully identified, they include: improving the quality of gasoline, vehicular technology and fixed sources; ensuring safe and adequate public transportation and bicycle infrastructure; and effectively controlling fleets of private and public transport.  Until now, these actions have been incomplete, inefficient and unable to solve the underlying problem. But the improvement of air quality during gasoline shortages has demonstrated that such solutions are possible. What’s more, actions aimed at reducing air pollution could have a double benefit. Tropospheric ozone is a greenhouse gas that aggravates climate change. It is a short-lived climate pollutant that stays in the atmosphere for only a few weeks, meaning that actions to control it have an almost immediate effect on public health, ecosystems and the climate. Therefore, in addition to improving the health of millions of people living in cities, Mexico has the opportunity to fulfill its international obligations on climate change. Diminishing ozone season requires the urgent and structural change of public policies, laws and their application. New standards must include a human rights perspective that prioritizes public interest and the health of children, and others, above vehicular mobility. While the development and implementation of these measures may not be easy, it’s essential we take the first steps toward the results we want to achieve.  Government efforts require the support of our entire society. Companies must contribute to the implementation of solutions, acting with due diligence. Academics, civil society organizations, trade unions and other sectors must contribute with our knowledge and participation to ensure that the plans and programs are ambitious and effective, and that they promote a just transition. Every resident of the city has a duty to contribute. A few weeks ago, Professor David Boyd, the United Nations Special Rapporteur for Human Rights and the Environment, published a report reiterating the obligation of States to guarantee the right to clean air, and the duty of companies to contribute. The report has recommendations related to tropospheric ozone that could be very useful for Mexican authorities. The enjoyment of clean air is a right that has yet to be met. Today almost two million children (from 0 to 14 years old) live in Mexico City, including mine. They and a large part of the more than 35 million children across the country could enjoy clean air; most live in cities and towns with air quality problems. According to organized trade, the celebration of Children's Day in Mexico involves an expenditure of 17 billion pesos ($900 million dollars) in gifts, an amount that could be used for authorities, companies and individuals to implement actions to ensure that the children of the country have something much more valuable: the ability to breathe air that does not endanger their health. This would be aligned with the goal of those who instituted the celebration of Children's Day in Mexico in 1924, and with the intention of the United Nations to establish one day a year to honor the importance of children's rights. Air pollution is, unfortunately, a regional and a global problem. Peru and Colombia also celebrate their children this month. Since their cities are among the most polluted in Latin America, what is reflected here can also be applied to those countries, and the continent as a whole. My gift for my children this year will be to continue working for better air quality in Mexico City, and to collaboratively build a future—hopefully a not-so-distant one—in which climate justice is a reality.

Leydy Pech, the guardian of the bees

“They’re part of my very being,” Leydy Araceli Pech Martin says of her bees. She feeds them pumpkin candy, and she identifies with them. Seeing how they organize and work together to produce honey reaffirms her confidence in collective action. In her native town of Ich Eq, a name that in Maya means “Star Eye,” families live in the same way: united and supporting each other. Of all the objectives that Leydy shares with her community, perhaps the most vital is the defense of their territory and traditional ways of life—threatened now by growing deforestation and the toxic contamination of industrial agriculture. The expansion of soy cultivation in Leydy’s town—located in the municipality of Hopelchén, in the Mexican State of Campeche—is killing large areas of tropical forest and indiscriminately spreading toxic pesticides through the land and water. It is harmful to both human health and the natural environment, particularly those ecosystems that depend on bees and, thus, beekeepers. Knocking down obstacles With a sweet look and a soft voice, Leydy is an agile woman. She does many things in a day, dividing her time between beekeeping, housework, caring for her mother and uncle, and keeping an eye on her son Diego Alberto, 17. She also manages the shop of Koolel-Kab (“women who work with bees”), an organization she founded with other women from Hopelchén in 1995. Together they breed and work for the preservation of melipona beecheii, a wild bee species that has been domesticated by the Maya people for hundred of years.  Using what the bees produce, the women make and sell honeys, soaps and creams in the organization’s store.  For Leydy, dedicating herself to beekeeping, a trade she learned from grandfather, which in the area is done mostly by men, has not been easy. She’s had to break down barriers. “We live in a world where only men have been able to speak and make decisions,” Leydy explained. “I’ve broken with that and they’ve questioned me.” At the beginning, the community underestimated the women’s potential. “They told us we wouldn’t achieve anything,” she said. “But little by little we demonstrated our abilities. The men saw the results of our work and publically recognized that the organization is an example of struggle, and success.” The women of Koolel-Kab work for the recognition of and respect for indigenous rights in the region. Leydy says their struggle began when they realized that other people were making decisions about the territory and natural resources of their town, about job opportunities and quality of life for their youngest members. Mennonites and industrial agribusiness have been cultivating genetically modified soybeans in Hopelchén, leading to mass deforestation and public health risks. The Mexican government authorized the cultivation without consulting affected communities. Although Mexico’s Supreme Court has recognized this human rights violation, the illegal planting of GMO soy has not stopped and the sowing of traditional soy has expanded. In addition, the aerial fumigation of crops is causing a harmful mixture of chemicals to reach houses, water sources, and the flowers the bees rely on. “I cannot sit idly by when I know what is happening,” explained Leydy, with the firmness that characterizes her. “It has become my responsibility. Not doing anything would be like betraying my own identity.” Leydy is motivated by the search for justice. Her organization of Maya women is part of the Collective of Maya Communities of los Chenes, which has presented national and international legal actions to stop the damages of agroindustry. AIDA, together with partner organizations, supports their efforts and has taken the case, on behalf of the communities, before the Inter-American Commission on Human Rights. The strength of unity Leydy is convinced that the strength of the Collective is its unity. Those in the Collective work for the needs of their own communities, but are also in the process of seeing themselves as one—something that applies not only to the people of Campeche, but also to those of the nearby States of Yucatan and Quintana Roo. “The Maya people are many, and everything that we’ve achieved is not for only one person, it is for all.” Leydy shares her leadership and her natural ability for teamwork. Her son, Diego Alberto, is part of that effort. “He’s happy, he understands a lot about bees and has his own projects,” she says.   Like Diego Albert, other young members of Leydy’s family are choosing to dedicate themselves to beekeeping. “That tells me I’m doing something right,” she says, proudly.

Organizations request Mexico list parrotfish as protected species

Parrotfish are vital to the health of coral reefs, and the Mexican State has an obligation to protect them. In a letter to the government, AIDA outlined the international obligations Mexico has to preserve its coral reefs, requesting that ten species of parrotfish be included in the nation’s list of protected species—a proposal spearheaded by the Healthy Reefs Initiative.   Mexico City. Using arguments based in international law and knowledge of environmental treaties, the Interamerican Association for Environmental Defense (AIDA) requested that the Mexican government include ten species of parrotfish in the national registry of protected species, under Official Mexican Law 059, which is currently being updated. AIDA made the request through a letter to the National Advisory Committee for the Normalization of the Environment and Natural Resources, in support of a proposal the Healthy Reefs for Healthy People Initiative made in September in coordination with Casa Wayuu, the Kanan Kay Alliance and the Mexican Center for Environmental Law (CEMDA). “The species of parrotfish we are trying to protect play a vital role in the survival of coral reefs because they feed on algae which otherwise deprive the coral of light and oxygen,” said AIDA attorney Camilo Thomson. “Populations of these fish have declined drastically due to habitat degradation, pollution and climate change. Studies done by the Health Reefs Initiative, among others, have shown that 60 percent of the coral reefs in the Mexican Caribbean are in either poor or critical condition.” The organizations are calling for the following species to be listed under some category of risk in Official Mexican Law 059: the stoplight parrotfish (Sparisoma viride), the rainbow parrotfish (Scarus guacamaia), the blue parrotfish (Scarus coeruleus), the midnight parrotfish (Scarus coelestinus), the queen parrotfish (Scarus vetula), the princess parrotfish (Scarus taeniopterus), the striped parrotfish (Scarus iseri), the redband parrotfish (Sparisoma aurofrenatum), the redtail parrotfish (Sparisoma rubipinne), and the yellowtail parrotfish (Sparisoma chrysopterum). The letter outlines the treaties and conventions that oblige the Mexican State to adequately fight threats to species requiring special protection—species like herbivorous fish, which are vital for the health of Caribbean reefs and other marine ecosystems. These agreements include the Convention for the Protection and Development of the Marine Environment in the Wider Caribbean Region (also known as the Cartagena Convention), the United Nations Convention on the Law of the Sea, the Convention on Biological Diversity, the Ramsar Convention, the Convention concerning the Protection of World Cultural and Natural Heritage, the Tulum Declaration, and the International Coral Reef Initiative. “The letter also mentions the Advisory Opinion on human rights and the environment issued by the Inter-American Court of Human Rights,” Thomson added. “In that decision, the Court strengthens States’ obligations to protect human rights and acknowledges the close relationship that has with environmental protection.” Despite serving as fish hatcheries and natural barriers against hurricanes—among other key functions—coral reefs are very fragile and vulnerable to climate change, the consequences of which include ocean acidification, sea level rise and algal blooms. The latter are caused by untreated or inadequately treated wastewater being pumped into the Caribbean, and other forms of marine pollution. “The most recent report from the Intergovernmental Panel on Climate Change (IPCC) warned that the warming of the planet’s average temperature by more than 1.5 degrees Celsius would result in the destruction of reefs,” explained Melina Soto, Mexico coordinator for the Healthy Reefs Initiative. “It is therefore urgent States adopt adequate measures to preserve coral reefs, and one way to do that is through the protection of herbivorous fish.” Find more information about the case here. Did you know coral reefs produce medicine?

“How can coral reefs contribute to modern medicine?” I wondered as I spoke to a group of doctors and nurses working on liver disease in Mexico. My uncle is part of the organization (Amihigo) and has long been interested in my work as a marine attorney with AIDA. When I got back from the meeting, the information I found backed up our discussion and clarified the link between our two worlds: coral reefs are natural, underwater pharmacies. The plants and animals living in reefs have developed chemical compounds to protect themselves against predators, fight diseases, and prevent the excessive growth of competing organisms. Corals have been recognized as an important source of new drugs to treat cancer, arthritis, Alzheimer’s, bacterial infections, viruses and heart disease, among other serious illnesses, according to the US-based National Ocean Service. The pharmaceutical industry has found corals provide value in the development of new products. Certain corals, for example, stimulate the welding of broken bones. Components of a Caribbean sponge allow for the creation of Zidovudina, a medicine used to treat HIV. Despite these discoveries, the medical use of coral reefs is considered underdeveloped. As an environmental attorney, what I take away from this realization is that if coral reefs are not effectively preserved, their great potential for modern medicine will never be fully realized. It’s a real threat. Studies estimate that 30 percent of the world’s reefs are already seriously damaged, and that 60 percent could disappear by 2030 due to water pollution, destructive fishing methods, overfishing, and other unsustainable human activities. Compounding these is the growing threat of climate change. Several Latin American nations are blessed with large areas of coral reefs that provide environmental and social benefits. But many don’t do enough to protect that wealth. Mexico’s coastline extends for more than 11 thousand kilometers, featuring 5,100 square kilometers of islands, reefs and cays. Its coral reefs span six major regions: the Gulf of California and the Western Mexican Pacific Coast, the Revillagigedo Archipelago, the Marias Islands, the South Pacific Coast, the Gulf of Mexico Reef Corridor and the Campeche Bank, and the Mexican Caribbean. The loss and degradation of these rich reef systems is a growing problem across the country. Unsustainable and poorly planned urban and coastal development is causing sedimentation and pollution, resulting in the growth of microalgae that rob light and oxygen, effectively suffocating the corals. In the Veracruz Reef System, the largest in the Gulf of Mexico, the expansion of the Port of Veracruz is doing just that. To protect reefs, it’s imperative that governments act with caution when approving land use in urban development plans to avoid damaging coastal wetlands (lagoons, bays, mangroves, coastal dunes and sea grasses, among others), and that they adopt adequate measures for wastewater treatment. The protection and restoration of coral reefs and coastal wetlands should be prioritized over economic interests and short-term economic benefits. Effective reef conservation can also be supported by good regulation practices.  Measures to protect key species such as the parrotfish from overfishing, for example, would go a long was to preserving the health of coral reefs. And we now know that the health of those reefs is directly tied to our own. It’s important the health industry—from doctors and patients to scientists and pharmacists—join the call to conserve our coral reefs, natural medicine banks that can help guarantee our rights to a dignified life and a healthy environment.

The shortsighted expansion of the Port of Veracruz

The powers behind the Port of Veracruz expansion project share a trait all too common in Mexico: a vision of development as the sum of short-term gains. But achieving those often requires squashing all possible obstacles, including our natural environments and the laws that protect them. “The first stage of the expansion of the Port of Veracruz will provide oxygen to the surrounding area for 15 or 20 years,” stated Juan Ignacio Fernández Carbajal, director of the Veracruz Port Authority. By oxygen, the director means economic income and new sources of employment derived from the port’s increased capacity. But this vision of development—so clearly shortsighted— ignores the social, environmental and economic benefits that the Veracruz Reef System has long provided, and which it will continue to provide for far more than 20 years. The second most important infrastructure project in Mexico’s recent history will irreversibly damage the largest coral ecosystem in the Gulf of Mexico, the Veracruz Reef System National Park. The reefs of Veracruz provide oxygen to Mexico and our planet in the most literal sense. The oceans and their ecosystems, particularly coral reefs, generate about half the oxygen we breathe and absorb almost a third of the carbon dioxide we emit. Coral reefs also produce 17 percent of all proteins consumed worldwide—a percentage that rises to 70 percent for coastal nations, according to a report by the United Nations Food and Agriculture Organization. They harbor more than 100 thousand different species of marine fauna, including thousands of commercial fish, which share their home with herbivorous fish, sea turtles and sharks. In good conditions, reefs protect coastal populations from storms, hurricanes and tsunamis—natural phenomena aggravated by climate change. They absorb up to 95 percent of the impact of waves generated by strong winds. The people of Veracruz know particularly well how the reefs have protected them. When hurricane Karl (a category four) hit the city in 2001, the Veracruz reefs provided a buffer that protected the city from the worst of the storm. Despite the fact that the reef system was designated a national protected area in 1975, and named a national park in 1992, the government decided to change the park’s boundaries in 2012 to allow for the expansion of the Port of Veracruz—effectively excluding the Punta Gorda reefs and Vergara Bay from the protected area. In purely economic terms—those clearly prioritized by the project’s promoters—by taking away the protection of those reefs, and putting their future at risk, Mexico’s oceans are losing value. The value of the environmental services provided by the now-unprotected Punta Gorda and Vergara Bay reefs is estimated around $290.5 million USD, a dramatic figure in light of the estimated value of the expanded port's activities.  The port expansion project has an estimated value of $85,600 USD per square kilometer, according to an article by the University of Veracruz, a figure that pales in comparison to the estimated value of ecosystem services provided by coral reefs, which ranges between $100,000  and $600,000 USD dollars per square kilometer, according to the United Nations Environment Program. The obligations Mexico ignored to promote the port “Unfortunately, when we thought the project was about to begin, we began to have environmental problems, which delayed the project for about three and a half years,” Fernández Carbajal explained. The “problems” to which the director is referring is the existence of protected coral reefs on site. “Since the problem was a national park, the government figured they’d remove it from the area so they could build the port without facing any legal obstacles,” Leonardo Ortiz, a researcher at the University of Veracruz, explained in our documentary short Battle for the Reefs of Veracruz. According to national law, the only activities permitted within the Veracruz Reef System National Park are those related to the protection of its natural resources, the increase in flora and fauna, and the preservation of its ecosystems and their elements. Port activities are clearly in violation of this law. So rather than stop the expansion project, the government chose instead to change the park’s boundaries, effectively unprotecting the reefs that fell within the port’s proposed limits. In doing so, the government failed to conserve the natural characteristics of the nation’s ecosystems for future generations. It also violated its obligations under the Ramsar Convention, an intergovernmental treaty for the protection of wetlands, under which the Veracruz Reef System is recognized as a Wetland of International Importance. What’s more, the project’s Environmental Impact Assessment was highly flawed in the following ways: The Port Authority requested a fragmented authorization of the project, which prevented an adequate and comprehensive assessment of the project’s cumulative impacts over time. By ignoring the existence of the once-protected reef located in the construction zone, the assessment failed to provide the best possible scientific data. It did not include protective measures for sea turtles that spend an important part of their life cycle in the park—particularly hawksbill turtles, a threatened species recognized by the Inter-American Convention for the Protection and Conservation of Sea Turtles. It failed to consider the impacts on the reef due to sedimentation, the dredging of the Bay of Vergara and Punta Gorda, and the increase in the quantity and size of the vessels in the new port. It ignored the fact that, by transporting an increased quantity of hydrocarbons, the port’s expansion increases the risk of spills in a region highly vulnerable to these incidents, which could seriously damage the highly biodiverse reef system in the Southeast corridor of the Gulf of Mexico. For all of the above reasons, residents of the city of Veracruz have filed a writ of amparo, denouncing the government’s blatant violations of human rights and environmental law. In the legal action—presented by the Mexico Center for Environmental Law (CEMDA) and supported by AIDA—residents attest that the port expansion project is violating their human right to a healthy environment. The question we must consider then, is this: Does the short-term economic advancement of a region matter more than the preservation of a 10,000-year-old reef system that guarantees biodiversity, sustainable tourism, food security, and enduring protection against climate change? For those of us who think of the long game, and consider the natural world to be our best ally on the path toward a sustainable future, the answer is clear. The port expansion must be stopped.
