The oil spill devouring life on Brazil’s beaches

Photos: Marcela Cintra / Text: Laura Yaniz  Since late August, oil has been registered at more than 500 points along 2,500 kilometers of coastline in northeastern Brazil. What began with the appearance of small black spots on some beaches quickly became huge stains that changed the color of the sand itself. The spill’s origin remains unknown, as local organizations and communities organize to clean up their beaches. Far from being resolved, the problem is getting worse every day. The oil’s advance is threatening the marine life in mangroves and coral reefs, both key ecosystems for the survival of species. In addition, residents of the affected communities, who depend on tourism and fishing, have seen their lifestyles and economies threatened. Their health is also at risk due to the consumption of contaminated seafood and direct exposure to the spill. Faced with the inaction of government authorities, the people have been cleaning the beaches and sea with their own hands. The spill itself, coupled with state neglect, violates the human rights of the inhabitants of the hundreds of affected beaches. AIDA—together with the Projeto Publico Institute, Salve Maracaipe, Projeto Caribessa and Rede Minha Jampa—denounced these violations before the Inter-American Commission on Human Rights in an effort to urge the Brazilian government to respond to this social and environmental crisis. Soledad García Muñoz, the Commission's Special Rapporteur on Economic, Social, Cultural and Environmental Rights expressed her solidarity with the Brazilian people and authorities in the face of the tragedy and called on the State to "take the necessary measures to avoid a bigger deterioration of the affected ecosystems, considering that the time, the resources and the way of acting focused on human rights are the key factors for the effectiveness of a contingency plan that the present situation deserves.” She added: “the slower and partial are the measures adopted, more irreparable will be the damages for the Brazilian coast and its biodiversity, as well as for the quality of life of the people that live in these affected regions. It is necessary an urgent and sensible response in face of these serious events generated by the contamination, because that could also accelerate the effects of the climate change in the coast, mangroves, swamps and other ecologically vulnerable habitats.”

Empowering fishermen to protect coral reefs, and their guardians

When he thinks of his childhood, Mario Smith remembers the abundance of fish, crabs and lobsters he and his father used to find while fishing, an activity now in decline on his island. "There used to be such abundance and today we are forbidden to fish for many things because of our irresponsibility in taking care of our resources," said Mario, who is now the leader of the San Luis Fishermen's Committee, whose members work on San Andres Island, Colombia. San Luis is a hamlet located on the east coast of San Andres with white sandy beaches and calm waters. I was there in August to support the dissemination of a very important resolution for the conservation of the coral ecosystems of the Colombian Caribbean. The law prohibits the capture and sale of several species of herbivorous and omnivorous fish that cleanse the corals of the algae that take away their light and space, thus supporting their survival. In recent years, a decrease in commercial species has led fishing communities have to go after herbivorous fish. This, in turn, has caused a reduction in populations of these species, particularly in the Caribbean. The resolution was issued on July 15 by the Corporation for the Sustainable Development of the Archipelago of San Andrés, Providencia and Santa Catalina (CORALINA), the environmental authority in that region. Disseminating and socializing these type of norms in local communities is very important so that residents, understanding the importance of these fish for the health of both the reefs and their economies, support actions aimed at their conservation. Along with CORALINA's education team, I visited several fishermen's committees, as well as schools and restaurants. I participated in a meeting of the Inter-Institutional Committee on Environmental Education, which was also attended by representatives of the government, the police, and the tourism and education sectors. The visits were very enriching, full of questions and emotions. In each of them I highlighted the benefits of taking care of our corals and the fish that help them thrive. Coral reefs are one of the most important ecosystems on the planet. They are home to more than 25% of our marine species and protect our coasts from hurricanes, storms and other weather events.  At Cajasai School, the active participation of one student surprised me. He told me of his concern about garbage on his beaches and about catching parrotfish, one of the most important species of herbivorous fish. "I'm very concerned about my resources and that's why I made a foundation to take care of the beaches that are close to my home," he told me passionately. His empathy and desire to fight for his beaches and sea inspired me. The beautiful landscapes of San Andrés and the interest of all the people I spoke with filled me with satisfaction and energy to continue working. But there is still a lot to do. Our marine resources are in danger of disappearing in the face of the global climate crisis. And the urgency to do something about it is becoming ever more pressing. Our coral reefs are among the ecosystems most threatened by this crisis, mainly due to changes in the acidity and temperature of our oceans. In addition, human actions such as pollution and overfishing are causing irreversible damages. Defend Yum Balam, a key ecosystem for biodiversity and the climate

AIDA presented an amicus brief demonstrating the importance of the protected area, as well as Mexico’s international environmental and human rights obligations to preserve it in the face of a 21,000-room hotel project that would imply significant damage to the site. Cancun, Mexico. The Interamerican Association for Environmental Defense (AIDA) presented a legal brief (Amicus Curiae) before the Seventh District Court of the State of Quintana Roo to defend the Yum Balam Flora and Fauna Protection Area, located in the north of the state. In 2018, when the site's Management Program was published, private and communal landowners filed several lawsuits against the program and the decree that created the protected area, arguing that it affected their rights to participation, property, and legality. Prior to the publication of the Management Program, the Advisory Council of the protected area received a report from a consultant who recommended the construction within Yum Balam of a mega tourism project that includes 21,000 hotel rooms, deeming it economically viable. "That viability is in doubt because each hotel room would generate changes in land use, population growth, loss of flora and fauna, and other irreversible damages to the ecological characteristics of the place," said Camilo Thompson, AIDA attorney. "What is at stake is Yum Balam’s contribution to the enjoyment of a healthy environment for present and future generations." The decree creating the protected area, which dates back to 1994, puts the public interest and regulation of natural environments that benefit the entire country above private interests. The Management Program is aimed at regulating the conservation and sustainable use of Yum Balam. The site is considered a Priority Wetland of International Importance under the Ramsar Convention. "According to a study, Yum Balam's mangroves and sea grasses prevent 38.5 million tons of carbon dioxide from escaping, equivalent to the greenhouse gas emissions of 9.4 million Mexican people," said Pilar Diez, Regional Director of the Mexican Center for Environmental Law (CEMDA-Southeast). In its 152 thousand hectares, the site also has reefs and coastal dunes. It is home to more than 90 percent of the endemic birds of the Yucatan Peninsula, sea turtles with special protection status, whale sharks, dolphins, and endangered terrestrial species like the jaguar. In fact, in the Maya language, Yum Balam means Señor Jaguar. "Our brief seeks to document the national and international importance of Yum Balam in the context of the climate crisis," Thompson added. "Betting on the development of tourism megaprojects is incompatible with the urgent task of confronting this crisis and achieving climate justice.” Both the United Nations Intergovernmental Panel on Climate Change (IPCC) and the Intergovernmental Platform for Science and Policy on Biodiversity and Ecosystem Services (IPBES) have been very firm about the current situation of ecosystem loss and the urgent actions that all countries must take in the face of the climate crisis. "We’ve documented the international legal framework under which the Mexican State is obliged to guarantee fundamental human rights, such as the right to a healthy environment," Thompson explained. "Mexico has the obligation to conserve its biodiversity, including coastal wetlands, forests, jungles and other ecosystems that regulate the climate and contribute to fishing and tourism." Resolution provides measures to protect corals in the Colombia Caribbean

Setting a positive precedent in Colombia and an important region of the Greater Caribbean, CORALINA has prohibited the fishing and commercialization of several species of herbivorous and omnivorous fish, a measure aimed at conserving the area’s coral reef ecosystems. San Andrés, Colombia. With the objective of conserving the coral reef and beach ecosystems of the Archipelago of San Andrés, Providencia and Santa Catalina, Colombia, the region’s autonomous corporation authority emitted a resolution prohibiting the capture and commercialization of several species of herbivorous and omnivorous fish. The waters around these Caribbean islands host the greatest marine and coastal biodiversity in Colombia, with more than 2,354 marine species registered to date. “This progress towards the conservation of corals and beaches occurs after a process of more than 20 years that included environmental education, research and monitoring,” said Nacor Bolaños, coordinator of protected areas for the Corporation for the Sustainable Development of the Archipelago of San Andrés, Providencia and Santa Catalina (CORALINA). “The need to protect parrotfish and other species of herbivorous and omnivorous fish was supported by artisanal fishermen themselves and by local communities, with whom we met.” The resolution issued by the decentralized public entity protects 14 species of parrotfish, four of surgeonfish, five of butterfly fish and six species of angelfish. It completely prohibits commercial, industrial, sport, or recreational fishing of these species. It also prohibits commercial fishing using harpoons and/or similar fishing gears. It also completely restricts their commercialization, possession and storage, as well as their transfer to other areas of the country. “The resolution is of great importance because it recognizes the benefits of corals for fishing, tourism, pharmaceutical resources, and protection against the impacts of the climate crisis,” said Maria José Gonzalez-Bernat, scientific advisor to AIDA. “It also recognizes the vital role several species of fish play in keeping these ecosystems healthy.” By feeding on algae that take away light and space from corals, herbivorous fish support the survival of these fragile environments. Numerous studies have demonstrated that parrotfish contribute to the growth of corals and the creation of sand for beaches. Some omnivorous species like angelfish also help to clean algae from corals. AIDA has supported CORALINA’s initiative since its inception, providing technical, scientific and legal information; and has advocated for the inclusion in the resolution of international and regional commitments that protect these fish. The Archipelago of San Andrés, Providencia and Santa Catalina concentrates 77 percent of the surface coral areas of Colombia and houses the third largest coral reef in the world. The area was declared a UNESCO Biosphere Reserve in 2000, and borders eight nations of the Greater Caribbean: Venezuela, the Dominican Republic, Haiti, Jamaica, Honduras, Nicaragua, Costa Rica and Panama. Why these algae-eating fish may be corals’ greatest allies

Numerous studies have shown that herbivorous fish play a fundamental role in the health and survival of coral reefs by removing the algae that robs corals of the light and space they need to grow. But populations of these small algae-eating fish are diminishing rapidly due to human activity, which puts our reefs at greater risk. In the Mexican Caribbean, for example, 60 percent of the reefs are considered in poor or critical health. There exist a diverse array of herbivorous fish in our oceans; they’re grouped into various families that are, in turn, divided into groups according to their feeding habits and roles in controlling algae growth. Parrotfish are among the most important species, as their strong beaks allow them to clean large amounts of macroalgae. Herbivorous fish live in tropical and subtropical waters, including many Latin American and Caribbean nations—Belize, Colombia, Guatemala, and Mexico, to name a few. These fish contribute to the health of key coral ecosystems like the Mesoamerican Reef System. Despite serving as fish hatcheries and natural barriers against hurricanes, coral reefs are extremely fragile and vulnerable to the global climate crisis, which is driving ocean acidification, sea level rise, and increased algae growth. Experts say that, when faced with the reduced presence of herbivorous fish, reef systems lose their capacity to recover from extreme weather events like hurricanes, which are becoming more and more powerful. But the relationship between herbivorous fish and coral reefs is at increasing risk. Dwindling herbivorous fish populations are evident in the Caribbean, where fishing communities have begun to capture parrotfish after overfishing commercial species. The destruction of mangroves and marine grassland habitats put these fish at risk, since many species of parrotfish rely on them during their life cycle. Environmental degradation also increases sedimentation and the concentration of nutrients, causing an increase in macroalgae. Algae growth and an increase in coral diseases are the result of pollution caused by inadequate wastewater management and runoff from commercial agriculture. These problems require the implementation of urgent measures aimed at preserving herbivorous fish populations and, with them, maintaining the health and regenerative capacity of coral reefs. Such measures should include the establishment and adoption of clear fisheries management and conservation strategies to ensure the recuperation of herbivorous fish, particularly parrotfish, populations. Protected marine areas or regeneration zones that prohibit fishing in key areas should also be created. To adequately protect these fish, States must also: standardize the monitoring of fish populations in the region and implement alternative management strategies; promote comprehensive, regional management that enables local authorities to share experiences and establish common conservation tools; and create and implement regulations and laws to combat overfishing and bad tourism practices, and promote low-impact coastal development. In nature, symbiotic relationships, like that of herbivorous fish and corals, are abundant. We must learn to recognize and value them. Likewise, if we take care of nature, nature will take care of us.

In historic decree, Costa Rica legally protects its corals

On the occasion of World Oceans Day, Costa Rica issued a decree to protect its vast coral ecosystems. We congratulate the government for taking this important step and setting a legal precedent for the protection of marine environments in the region.  San José, Costa Rica.  The Costa Rican government issued a precedent-setting decree today that legally protects its vast coral ecosystems from harmful human activities. Following years of work on the issue, the Interamerican Association for Environmental Defense (AIDA) and Conservation International celebrate this important instrument for the conservation of these fragile and vital marine environments.   “We are very pleased with this advance, promoted by the Vice Ministry of Water and Seas, which guarantees the survival of coral reefs and the various species that contribute to their conservation—species like the parrotfish, which feed on the algae that can deprive reefs of oxygen,” said Gladys Martínez, senior attorney of AIDA’s Marine Biodiversity and Coastal Protection Program.  The decree provides a series of measures the government must adopt in order to preserve reef ecosystems and the species that depend on them, threatened by a combination of unsustainable use, climate change, inadequate management, and invasive species.  The measures include: the creation and implementation of science-based strategies and policies to confront the effects of climate change; and the restoration of degraded reefs. The law also prohibits harmful activities like the extraction and commercialization of reefs, dumping of waste, and anchoring.  “It’s our hope that the legal precedent established by this decree will be replicated in other countries of the Americas that, like Costa Rica, are bound by international treaties to safeguard their corals,” said Magie Rodríguez, AIDA attorney. “In the coming years, we will be closely monitoring the decree’s implementation.”  In 2012, AIDA and Conservation International joined forces with national experts to prepare a report detailing the economic and environmental benefits of corals, urging the creation of legislation in Costa Rica to protect them.  AIDA also supported the Vice Ministry in the preparation of the decree based on the organization’s experience in international law and understanding of regulations in other countries of the region.  “Costa Rica is a nation privileged by the dimensions of its marine spaces and biodiversity. The coral systems are incredibly productive, but they are also threatened by human activity and climate change,” said Marco A. Quesada Alpízar, director of Conservation International - Costa Rica. “By taking action on this issue, Costa Rica has assumed responsibility for the conservation and management of its marine ecosystems, and has set an example that can be replicated in other countries.”  The decree answers a years-long call for Costa Rica to comply with international obligations and protect its threatened marine ecosystems. Scientific studies have shown that a large part of the coral reefs in the country are at great risk due to human activities including land-based pollution and destructive fishing practices. Their conservation must be a priority.  “This decree fills an important gap in the regulation of coral reefs in Costa Rica. Herbivorous fish and coral reefs: a relationship we must protect

Vibrantly colored herbivorous fish feed on the macroalgae that covers coral reefs. These fish play a fundamental role in the health of marine environments by cleaning the algae that deprive corals of light and oxygen. They are vital for maintaining the ecological equilibrium necessary for the reef’s survival. Recommendations for saving herbivorous fish Targeted measures are urgently needed to maintain and improve the health of coral reefs. Protecting the colonies of herbivorous fish that sustain them would go a long way toward helping reefs recover. In order to do so, AIDA recommends: Establishing and adopting strong fishing management and conservation strategies that will help herbivorous fish (particularly parrotfish) populations recover. This includes fishing management initiatives, establishing temporary or location-based bans, and strict quotas on fishing. Other measures include encouraging fisheries to diversify the species they capture. In the Caribbean, for example, fishing for lionfish—an invasive species—could be promoted as a viable economic alternative in hundreds of fishing communities. Establishing marine protected areas and recovery zones where fishing is prohibited. These areas or zones, which should include at-risk habitats, need urgent protection because they are considered refuges for juvenile and adult fish. Allowing herbivorous fish species to complete their life cycles would contribute to the resilience of key marine environments like coral reefs. Standardize monitoring techniques of fish populations and implement alternative management practices. Encouraging optimal standard practices would allow scientists working in diverse habitats to improve monitoring, as well as fishery and ecosystem management. Among other options, reef restoration is also extremely beneficial, and has already been adopted in several areas of Mexico. Promote comprehensive regional management systems that allow local authorities to share experiences and establish shared management and conservation tools. Create and implement norms and laws that protect reefs and herbivorous fish. These could include laws that promote adequate fishing management practices and effectively combat threats like overfishing and tourism that damage reef habitats. Putting my heart in the conservation of wetlands

Coral reefs are my favorite wetlands. They’re full of so many colors and shapes, and simply teeming with life. When I’m underwater, my heart is full of peace and excitement, as I see myself surrounded by so many forms of life, so many species living together. As a marine biologist, I’ve had the opportunity to scuba dive in a variety of countries and see many of these beautiful ecosystems up close. Of all my dives, the ones I enjoyed most were those I did—for work and for pleasure—in the Bay Islands of Honduras. As a recent college graduate and volunteer with the Atlantic and Gulf Rapid Reef Assessment Program, I was in charge of monitoring the countless organisms that live in or on the reefs—seaweed, sea urchins, lobsters, queen snails, and so many others. Without a doubt, my time diving in the Cayos Cochinos sparked my personal and professional journey. Since then, I’ve set out to protect these magical ecosystems, vital to all life this planet. My current role, as scientific advisor to AIDA, uses science to strengthen the legal arguments employed to protect these and other at-risk natural environments in Latin America. Wetlands, vital and at-risk In addition to coral reefs, wetlands—characterized by the presence of water—include lakes and rivers, underground aquifers, swamps and marshes, grasslands, peat bogs, estuaries and deltas, mangroves, and sea grasses. Wetlands act as the “kidneys” of the planet because they recycle water and waste, retain sediment and nutrients, reduce erosion, and absorb carbon dioxide from the atmosphere, in turn mitigating climate change. However, it’s estimated that since 1700 we’ve lost nearly 87 percent of our wetlands at a speed three times greater than the loss of our natural forests. This has caused a drastic reduction in biodiversity, affecting 81 percent of continental species and 36 percent of marine and coastal species. Among the greatest threats to our wetlands are contamination by garbage, wastewater and industrial pollution; changes in land use; agricultural runoff, erosion and climate change. What’s more, global warming is increasing the temperature of the oceans, raising sea levels, and melting the poles. According to the Intergovernmental Panel on Climate Change, an increase of 1.5°C in global temperature could kill almost 90 percent of the world’s coral reefs—an irreversible and heartbreaking loss. Taking action to save wetlands Given this frightening global scenario, urgent action is required to protect our planet’s wetlands. In fact, there are many ways we can begin to do so immediately, such as: Creating restoration campaigns for vital ecosystems like mangroves and coral reefs. Declaring natural protected areas, to conserve wetlands and the species that depend on them. Developing policies that allow for the rational use of wetlands, where conservation is prioritized. Prohibiting the destruction of these ecosystems in any type of project, be it tourism, development or infrastructure. Establishing water treatment plans to prevent drainage and runoff from contaminating wetlands. Every year, on February 2, we celebrate World Wetlands Day, commemorating the signing of the Ramsar Convention, the only intergovernmental treaty for the conservation and rational use of our planet’s wetlands. This year’s celebration is focused on wetlands and climate change, inviting us all to reflect on the value of our wetlands, the critical services they provide, and urgency with which we must protect them. We are not powerless in the face of climate change. Saving our wetlands may just be the first step toward saving our planet, and ourselves.

Six advances for Latin America’s reefs in 2018

In 2018, we joined people and organizations around the world in celebrating the International Year of the Reef. AIDA was part of a global movement to increase awareness of the value of reefs and the threats they’re facing. To advance reef conservation in the Americas, we took part in a variety of legal actions to protect reefs in Mexico and the Caribbean. As always, we’re proud to celebrate the small victories we’ve achieved on the road to environmental justice in 2018. Together with our supporters and allies we:   Supported a case in defense of the Veracruz Reef In February, we presented an amicus brief in support of an amparo filed by local residents against the expansion of the Port of Veracruz. We outlined how Mexico’s approval of the project in 2013 violated the nation’s international environmental and human rights commitments. Just a year earlier, the government had reduced the area of the reef system, changing its boundaries to make the project viable. At the time of authorization, adequate scientific information was not available to understand how to avoid damaging the reefs and protect the services they provide to the people of Veracruz. To raise awareness of the issue, we also co-produced a documentary, Battle for the Reefs of Veracruz.   Alerted the Ramsar Convention to threats to Puerto Morelos Reef We sent an Urgent Alert to the Secretariat of the Ramsar Convention, alerting them to the threats to Puerto Morelos Reef National Park, a national protected area and Wetland of International Importance. Together with a coalition of civil society organizations, we solicited a visit of international experts to evaluate the risks facing the site, particularly changes in land use in coastal ecosystems due to massive and unsustainable tourism development.   Created a Working Group on Threats to Mexico’s Wetlands In May, the Working Group on Threats was created within the National Wetlands Committee, which AIDA helped create in order to motivate Mexico to comply with its obligations to protect at-risk wetlands of international importance. Within the framework of this Group, efforts are being made to strengthen national actions to protect Ramsar ecosystems, including reefs and the herbivorous fish that make their home in them.   Supported the protection of 10 species of parrotfish in Mexico’s Caribbean In October we presented a letter of support outlining international environmental and human rights arguments for the inclusion of 10 species of parrotfish on Mexico’s national list of at-risk species. While the inclusion has been acknowledged and accepted, official confirmation is expected early this year. Our efforts supported a proposal of the Health Reefs Initiative that seeks to legally protect parrotfish species, which are critical to maintaining a healthy coral reef ecosystem. Parrotfish and other herbivorous fish feed on algae that compete with corals for light and oxygen, thus enabling the reef to flourish.   Helped Establish a Working Group on Corals in Costa Rica In coordination with the Ministry of Environment, we helped organize a working group of academic experts, members of civil society and competent governmental authorities that will propose comprehensive solutions to the problems facing the country’s coral ecosystems. Together we will work to ensure integral solutions to protect Costa Rica’s coral reefs.   Supported a Working Group on Herbivorous Fish in Guatemala In coordination with the Healthy Reefs Initiative, academics from San Carlos University and members of the government, we’ve supported the creation of a working group to draft a technical-scientific document that outlines the information necessary for a ministerial decree to prohibit the fishing of herbivorous fish in the Guatemalan Caribbean and, thus, protect the nation’s reefs.
