Inter-American Development Bank washes its hands of responsibility for dangerous Hidroituango dam and related human rights violations in Colombia

Fearing imminent collapse of the dam, communities in Antioquia, Colombia, have learned that the public lending arm of the Inter-American Development Bank (IDB) will not be investigated. Washington, DC — Last month, the Board and management of the Inter-American Development Bank (IDB) announced it would not approve an investigation of the Bank’s role in financing the construction of the controversial Ituango Hydroelectric Project (Hidroituango) in Colombia. The decision disregards allegations of acute and far-reaching harms caused by the project, including a humanitarian crisis that has displaced hundreds of families and caused human rights abuses, including assassination and intimidation of community members who oppose the project. The announcement comes more than a year after communities affected by the construction of the Hidroituango dam on the Cauca River in Antioquia, Colombia, filed a claim with the Independent Consultation and Investigation Mechanism (MICI). The claim, signed by more than 400 individuals affected by the dam, sought recourse from the MICI for the IDB’s alleged failure to comply with its own environmental and social safeguards. "We publicly denounce the IDB’s decision to evade its responsibility for the environmental damage and human rights violations resulting from the Hidroituango project, and we condemn the role of the MICI in facilitating and manifestly supporting this decision,2 remarked Isabel Zuleta, representative of Movimiento Ríos Vivos Antioquia. "It is unconscionable that the IDB is attempting to rewrite history by absolving itself from its responsibility for enabling and financing high-risk development projects that have extreme environmental impacts and blatantly violate human rights," added Zuleta. The IDB has two lending arms, one that invests in the public sector (the IDB) and another that invests in the private sector (IDB Invest). The MICI is the accountability mechanism of the bank, in charge of evaluating environmental and social compliance of the institution’s investments. The IDB initially invested in the Hidroituango project in 2012, which paved the way for and facilitated millions of dollars of additional investments from the IDB, as well as an additional billion from other international banks. The MICI, whose mandate is to provide accountability for harms caused by IDB investments, recommended no investigation of the IDB’s role in the project. Despite the decision not to review the IDB’s compliance, the MICI could continue its investigation regarding IDB Invest’s investment in the Hidroituango project. However this will depend completely on approval by the Bank’s Board. Before the dam was approved, communities warned of precisely the environmental and social impacts that have occurred. "For an institution that seeks to improve the lives of people in Latin America, the IDB’s decision is absurd, irresponsible, and disrespectful. It exemplifies a complete disregard for people living within the Cauca River Basin. Unfortunately, this disregard too often characterizes the IDB’s engagement in large-scale infrastructure projects throughout the region," said Alexandre Andrade Sampaio of International Accountability Project. "What is the value of environmental and social policies at the IDB, when they are ignored and dismissed precisely when they are most needed to protect people’s lives? This lack of accountability is unacceptable, and it demonstrates why communities affected by the actions of development banks have found it necessary to resort to the courts to secure their rights," remarked Carla García Zendejas, Senior Attorney at the Center for International Environmental Law (CIEL), in reference to the recent US Supreme Court decision in Jam v. IFC, which recognized that international organizations such as the IDB are not immune from litigation in US courts. "This decision exemplifies the perils of an accountability mechanism that lacks the independence and legitimacy to initiate and carry out a genuine investigation of a bank’s projects," added García Zendejas. "Since day one, the Hidroituango project carried out a weak impact assessment, inaccurate surveys of affected people and deficient environmental implementation and monitoring, but the IDB has continued to invest in it," sustained Carlos Lozano, Senior Attorney at the Interamerican Association for Environmental Defense (AIDA). "The project was approved and is under construction without having previously carried out an evaluation of alternatives," he pointed out. Members of Movimiento Ríos Vivos Antioquia, who represent affected communities in the complaint, continue to receive ongoing threats and suffer intimidation, homicides, and other forms of violence. The IDB has shown its disregard for the volatile situation surrounding Hidroituango, including the continued presence of paramilitary groups in the area. The IDB has also ignored community requests to delay dam construction to exhume mass graves from the armed conflict in the area affected by the dam. The IDB Group has financed the project through various types of investment: initially $2 million in technical cooperation for the Colombian State in 2012 and then $550 million in direct investments in 2016 to Empresas Públicas de Medellín (EPM), the company in charge of the project. Additionally, the IDB manages a $1 billion dollar loan package, with funds from multiple institutional investors, including European banks. After a construction failure at the dam construction in May 2018, more than 25,000 people had to be evacuated from the area due to flooding, landslides, and avalanches. The humanitarian crisis has worsened dramatically: people have lost their property, livelihoods, and access to health and education services, which have always been meager in the area. Many people have been displaced and those who have stayed are not properly cared for. In addition, people who are members of Movimiento Ríos Vivos are discriminated against. There is a lack of food, people suffer from diseases, and shelters are deficient. People are pressured to return to risk areas and sign documents waiving their claims. In short, communities are facing a situation of systematic human rights violations as a result of the project.

The False Promises of Hydropower

How dams fail to deliver the Paris Climate Agreement and UN Sustainable Development Goals A Joint Statement by Civil Society Organizations on occasion of the 2019 World Hydropower Congress in Paris, France We live in an age of urgency. Scientists have warned that we have little time to act to bring climate change under control and protect the integrity of life on our planet. Confronting the climate crisis requires creative solutions that both protect nature and respect human rights. Facing these challenges, we cannot remain silent onlookers while corporate profiteers, financiers, and their allies peddle false solutions for addressing climate change and implementing sustainable development. A flagrant example of such deception is the attempt to portray large hydroelectric dams as a ‘clean and green’ source of energy, as can be seen at the 2019 World Hydropower Congress. Organized in Paris by the industrial lobby of the International Hydropower Association (IHA) in partnership with UNESCO, the conference’s title reads, “Delivering the Paris Climate Agreement and the Sustainable Development Goals.”   Such glossy portrayals of hydroelectric dam projects—with an eye toward capturing financial incentives through mechanisms like Climate Bonds and the Green Climate Fund—conveniently ignore a long legacy of social and environmental catastrophes, economic waste and, all too often, massive corruption schemes that are the antithesis of truly sustainable development. ... A Call for Action The undersigned civil society organizations call on the members of the International Hydropower Association, governments and international financial institutions to implement the following urgent actions:  Steer priorities, investments and financial incentives away from additional hydroelectric projects and towards energy efficiency and truly sustainable renewable energy options (solar, wind and biomass and, when appropriate, micro-hydro). Special attention should be given to opportunities for technological innovation, decentralized generation and improving energy access among isolated, off-grid communities. Eliminate financial incentives for new hydroelectric projects within climate change mechanisms, such as the Green Climate Fund and Nationally Determined Contributions, and within programs to promote implementation of the UN Sustainable Development Goals (with the possible exception of micro-hydro projects). Commission independent audits of controversial existing dam projects and basin-wide cascades in terms of their social and environmental consequences, identifying steps to mitigate impacts and ensure just reparations for affected communities, based on direct consultations. When such measures are prohibitively expensive or otherwise inviable, the de-commissioning of dam projects should be promoted.  Ensure the alignment of operational procedures for existing hydroprojects with relevant territorial plans at the basin level, such as integrated water resource management and protected areas that ensure key ecological processes and the rights of local communities, based on the concepts and tools of participatory, adaptive management. Ensure that renewable energy policies and projects adopt, across the board, robust guidelines to safeguard human rights and environmental protections, such as ILO Convention 169 and the UN Principles on Business and Human Rights. No energy facilities that potentially impact the territories and livelihoods of indigenous peoples and other traditional communities should be authorized without obtaining the free, prior and informed consent of the community and ensuring the cooperative design of co-management strategies. Among the benefits of such a paradigm shift in energy strategies and development planning will be major contributions toward protecting the world’s last free-flowing rivers, vital for climate resiliency, biodiversity conservation and sustainable livelihoods.  Energy companies and governments must halt all efforts to dam the world’s remaining free-flowing rivers and concentrate instead on: i) improving efficiency and the sustainability of existing hydropower projects and cascades; and ii) investing in energy efficiency and truly sustainable renewables.  Moreover, governments must urgently promote the permanent legal protection of the world’s last free-flowing rivers, including transboundary watercourses, with due respect for the territorial rights of indigenous peoples and other traditional communities, who play fundamental roles as the guardians of healthy rivers. Statement on the Assassination of Dilma Ferreira Silva, leader of Brazil’s Movement of Dam-Affected Peoples

In the face of the brutal crime committed on March 22nd against a coordinator of the Movement of Dam-Affected Peoples in Brazil, the undersigned human rights and environmental organizations call on Brazilian authorities and multilateral organizations to ensure that the country’s obligations regarding the protection of human rights and environmental defenders are enforced. With deep sadness and indignation, we received the news that Dilma Ferreira Silva, a regional coordinator of Brazil’s Movement of Dam-Affected Peoples (MAB), together with her husband Claudionor Costa da Silva and Hilton Lopes, a friend of the family, were assassinated on Friday, March 22nd in the Amazonian state of Pará. The bodies of the three victims were found in her residence with signs of torture. Dilma Ferreira Silva was a prominent activist and recognized leader who, for more than three decades, fought for the rights of the people affected by the Tucuruí mega-hydroelectric dam project on the Tocantins River of the Brazilian Amazon, built during the country’s military dictatorship 1964-1985), provoking the displacement of an estimated 32,000 people, along with serious environmental damage. This is not the first case of a brutal murder perpetrated against a human rights defender in the region of the Tucurui dam.  In April 2009, Raimundo Nonato do Carmo, a union leader who fought on behalf of those whose lives were ruined by the Tucuruí dam was shot seven times by two men on a motorcycle as he walked out of a supermarket on the street in which he lived in the town of Tucuruí. Dilma dedicated her life to promoting national policies that would effectively take into account the rights of dam-affected peoples, with due attention to gender issues that particularly affect the rights of women. Dilma Ferreira lived in the rural settlement of Salvador Allende, where land titles were issued for family farmers by the federal government in 2012, as a result of a popular mobilization of the Movement of the Landless Workers (MST), with support from MAB.  However, the area continued to be coveted by land grabbers (grileiros) that invade and seize control of public and community lands.  One such example is Fernando Ferreira Rosa Filho (aka ‘Fernandinho’) arrested by the civil police force of the state of Pará as the principal suspect in the triple homicide of Dilma Ferreira, Claudionor Costa da Silva and Hilton Lopes. The assassination of Dilma Ferreira Silva is evidence of the grave situation faced by human rights and environmental defenders in Brazil, a country that tops the global ranking in violence practiced against defenders, with one person murdered every six days in 2017. The incoming administration of President Jair Bolsonaro has intensified recent attempts to undermine Brazil’s progressive legislation on environmental protection and human rights - especially those of indigenous peoples, quilombolas (descendants of African slaves), family farmers and other traditional populations.  Such attempts have often clashed with Brazil’s progressive Federal Constitution, approved in 1988 during a period of redemocratization that followed military rule. Backsliding on public policies, together with public statements that incite violence in conflictive areas, are seriously increasing the risks faced by human rights and environmental defenders such as Dilma Ferreira Silva. The undersigned human rights and environmental organizations express our solidarity with the family of Dilma and the Movement of Dam-Affected Peoples (MAB). Without a doubt, her assassination is a huge loss for the defense of the environment and human rights in the Amazon. We stand with the UN High Commissioner on Human Rights in demanding a complete, independent and imparcial investigation of the assassination of Dilma Ferreira Silva, as well as the exemplary punishment of those that carried out and ordered this horrendous crime. Moreover, we call on Brazilian authorities to ensure that the country’s domestic legislation and international obligations regarding the protection of human rights and environmental defenders are fully implemented, including preventative action to avoid further acts of violence. Inter-American Commission urges Brazil to address damages to indigenous peoples caused by Belo Monte Dam

Following its visit to Brazil, the Inter-American Commission on Human Rights called the attention of authorities and civil society to the urgent need to address repeated violations of the rights of indigenous communities. The Commission highlighted the case of the Mïratu de Paquiçamba community, which has been affected by the construction of the Belo Monte Dam. Rio de Janiero, Brazil. Concluding its visit to the country, the Inter-American Commission on Human Rights (IACHR) urged Brazilian authorities and society in general to recognize, address, and quickly resolve repeated violations of the human rights of indigenous communities. The Commission emphasized the case of the Mïratu indigenous community, affected by the environmental damages caused by the construction of the Belo Monte Dam. In Brazil, indigenous communities “suffer from frequent incidents of violence and lack of attention from public services, in addition to increased difficulties and obstacles surrounding claims to their lands,” said Commissioner Antonia Urrejola Noguera, IACHR Rapporteur for Brazil, while presenting the Commission’s preliminary conclusions. “Brazil has been one of the largest violators of the human rights of indigenous communities. In their meeting with the Commission, the Brazilian Indigenous Communities Organization (APIB) presented these cases and expressed its concern over the current political landscape, in which a discourse of hatred and racism has been growing, even among government institutions,” said Luiz Eloy Terena, APIB’s legal advisor. On November 7, the Commission’s delegation visited Mïratu Village, located in the Paquiçamba indigenous region in the state of Pará. Mïratu is one of the indigenous communities affected by the Belo Monte Dam. It was the first time the Commission visited that area. There, the Commission heard testimonies from indigenous people and fishermen, who are fighting to maintain their traditional way of life despite damages including: the death of thousands of fish; the pollution of the Xingú river; forced displacement from their lands without adequate relocation; and the development of culturally inappropriate projects. Village leaders reported that those damages have disproportionately affected women and children. The Commission also heard from representatives of Altamira, the city nearest the dam. “We’d like to highlight the importance of the Commission’s historic visit to Mïratu Village, and recognize the negative impacts that the Belo Monte Dam has had on the human rights of the people of the Xingu River basin,” said Astrid Puentes Riaño, co-director of the Interamerican Association for Environmental Defense (AIDA). “It is now up to the government of Brazil to adopt the decisions and recommendations of the Commission, complying with the rule of law and protecting the people of their country.” During the visit, those affected by the dam were especially concerned over next year’s scheduled implementation of a plan to manage the flow of the Xingú River. Known as a consensus hydrogram, it would divert the water that indigenous and riverine communities, as well as plants and animals, rely on to survive. “The commissioners had the opportunity to confirm the severity of the impacts and the understand the urgent need to revise the criteria used to define the residual flow that the Xingu must maintain in order to guarantee the subsistence and culture of indigenous and riverine communities in the Vuelta Grande region,” said Bivany Rojas from the Socio-environmental Institute (ISA). In 2011, communities along the Xingu—represented by AIDA, the Paranese Society for the Defense of Human Rights (SDDH), and Justiça Global—filed a complaint against Brazil, bringing the case in front of the Commission. That same year, the Commission granted precautionary measures to affected indigenous communities. The case formally began in December 2015, and participating organizations presented final arguments in May of this year. Based on those and the arguments put forward by the the Brazilian State, the Commission will publish a report concluding whether human rights violations occurred from the construction of the Belo Monte Dam. They may then decide to issue recommendations for Brazil to remedy those damages. Say no to large dams: 3 reasons to opt for alternative energy sources

By Florencia Ortúzar and Monti Aguirre* Hydroelectric energy has been one of the largest drivers of development in many Latin American nations, and still represents a large portion of the region’s energy matrix. But is it really the best option? In response to a blog by the Inter-American Development Bank reflecting on the future of the hydroelectric sector in Latin America, we’d like to reflect on what it means to continue betting on large dams in Latin America. What follows are three reasons why we must say no to more large dams: 1. Better alternatives to hydroelectricity exist, and should be considered in project planning Before selecting an alternative energy source, governments and companies should develop a strategic plan that analyzes energy needs and the best way of achieving them. In this analysis, all options must be considered. It’s worrysome that this doesn’t already happen. For example, in the case of the Hidroituango dam—thought to be the largest in Colombia and associated with serious socio-environmental damages—the government decided to not conduct a prior evaluation of alternatives. Although the law did not require it at the time, the evaluation was recommended and is an international standard that large financial institutions should apply when investing in projects of this type. Today, other energy sources—like wind and solar—are proven to be economically competitive, can be constructed more quickly, and do not aggravate climate change. Innovations in smart grids, power storage and batteries also solve intermittency problems and make hydroelectric plants unnecessary. Geothermal, tidal, and wave energy are alternatives, the potential of which we have not even glimpsed. The promotion of large dams only delays adoption of the truly clean energy solutions that Latin America and the planet desperately need. According to the Bank’s own studies, Latin America has the largest quantity and most varied sources of renewable energy in the world. The region's renewable resources could provide almost seven times the installed capacity worldwide, excluding hydroelectric power. Therefore, although the region still holds great potential for untapped hydroelectric power, it’s necessary to conduct a comprehensive evaluation of the situation, taking into account the costs and benefits as compared to other energy options. Only then can governments decide whether it’s worth continuing to invest in hydropower, or whether it’s better to opt for other types of energy—thus avoiding the social, environmental and financial impacts that come with large dams. 2. Large dams cause socio-environmental damage and are not profitable It has been demonstrated repeatedly that the socio-environmental impacts of hydroelectric plants are greater than initially considered. In addition to forced displacement and the criminalization of those who oppose them, large dams flood land, reduce river flows, and change the ecosystems of downstream wetlands, destroying habitats and contributing to species extinction. All this impacts the lives of nearby communities, limiting their ability to adapt to climate change. In economic terms, a study by the University of Oxford concluded that “even before accounting for the negative impacts on human society and environment, the actual construction costs of large dams are too high to yield a positive return.” In it, researchers show that the budgets and timeframes of large dam projects are consistently underestimated. Brazil’s Belo Monte Dam, for example, ran two times over its original budget, making it the most expensive public works project in the Amazon region. The budget of Chile’s Alto Maipo Dam has doubled four times over since the project was approved in 2009. Recognizing that the costs far outweigh the benefits, some countries have opted for dismantling large dams. And private companies have scrapped hydroelectric projects altogether because they are neither economically viable nor profitable. The United States government  has adopted a policy to refuse any loan, donation, strategy or policy supporting the construction of large dams. 3. Large dams contribute to climate change Climate change must be considered when discussing the relevance of hydroelectricity. Reservoirs generate significant quantities of greenhouse gases, particularly methane, which is 30 times more effective at trapping heat than carbon dioxide. Likewise, the construction of dams endangers valuable carbon sinks like rivers and forests. For that reason, a proper analysis of carbon dioxide and methane emissions should be conducted before choosing a dam project—a process that usually doesn't occur. Another aspect to consider is the vulnerability of dams to climate variations. Extreme rainfall increases sedimentation, which can cause structural problems and reduce the dam's lifespan. Droughts, now increasingly frequent, can render dams inefficient. As more dams lose efficiency, Latin America—now highly dependent on hydroelectricity—will be more vulnerable to energy shortages. Even more serious is the threat posed by large dams in extreme weather events. In a dam gave way during bad weather, erasing entire villages. In Laos earlier this year, mass evacuations were ordered after heavy rains threatened a dam collapse. In Kerala, India, torrential rains, coupled with the mismanagement of several dams, have caused unprecedented flooding. In certain countries, the risk of dams overflowing or collapsing has already been recognized as a serious problem. Over time, more hydroelectric plants will begin to deteriorate and will require large investments to safeguard the communities living downstream. As civil society representatives working for a more just and sustainable Latin America, we urge financial institutions like the Inter-American Development Bank to support the change we as a region need. We call on them to stop investing in large dams, which have been demonstrated time and again to be dangerous to the environment and local communities, costly for countries, and unsuited for our rapidly changing climate. It’s time for a better energy plan. In Xingu management plan, Brazil leaves communities without water

The proposed Xingu River management plan puts at risk the people, plants and animals of the Amazon region. AIDA requested that the Inter-American Commission on Human Rights urge Brazil to stop the plan and establish a socially and environmentally appropriate alternative. Washington, D.C. and Altamira, Brazil. By authorizing the construction of the Belo Monte Dam in the heart of the Amazon, the Brazilian government endorsed a management plan for the flow of the Xingu River that would leave the indigenous and riverine communities of the area without the water they need to survive. The plan is in a testing phase but is expected to be implemented next year, once all the turbines of the hydroelectric plant are installed. The Interamerican Association of Environment Defense (AIDA) sent a report to the Inter-American Commission on Human Rights detailing the serious socio-environmental risks of the plan. In it, we requested that the Commission urge Brazil to stop the plan’s implementation and create an alternative plan that guarantees biodiversity and protects the communities’ ways of life. “The authorized plan for the management of the river’s flow threatens the existence of indigenous and riverine communities, and places at risk of extinction the fish and the forests—natural resources on which the physical and cultural lives of the communities depend,” said Liliana Ávila, Senior AIDA Attorney. The plan, called a consensual hydrogram, establishes the volume of water that will pass through a specific part of the river, called the Vuelta Grande, and the part that will be diverted for energy production. It is intended to artificially reproduce the natural flow of the river in times of flood and drought. Norte Energía, the consortium in charge of the dam, proposes an average minimum flow rate of 4,000 cubic meters per second over the course of a year, and 8,000 cubic meters per second for the following year, beginning in 2019. It proposes a minimum flow rate of 700 cubic meters per second for the dry season. The report sent to the Commission, however, details scientific and social evidence that demonstrates that these water levels are significantly lower than the historical river flow and do not guarantee that fish and alluvial forests can survive the proposed reduction in the short- and medium-term. The evidence—which includes information from both the Brazilian Institute of the Environment and Renewable Natural Resources and community monitoring—also shows that some aquatic species, such as chelonians, can only feed and reproduce with minimum flows of 13,000 cubic meters per second in times of flooding, and that the volume proposed for the dry season could make the river unnavigable. “The management plan did not take into account the monitoring done by the Juruna people in collaboration with the Federal University of the State of Pará and the Socio-environmental Institute (ISA),” said AIDA attorney Marcella Ribeiro. “In 2016, with water levels higher than those proposed, communities were already reporting the mass die-off of fish.” AIDA sent the report to the Commission as part of a formal complaint against the Brazilian State for the human rights violations caused by the dam’s construction. In May, together with partner organizations, we presented our final arguments in the case, evidencing damages already caused, including the forced displacement of indigenous and riverine communities, the massive death of fish, differentiated damages to men and women, and threats to the survival of the communities. Guatemalan indigenous communities file complaint for dams’ damages

Affected communities have called on the Inter-American Development Bank to withdraw funding for the Pojom II and San Andrés dams for failure to comply with its operational policies. The mega-projects have damaged water sources and harmed the livelihoods of local indigenous people, particularly women. Washington, D.C.  Indigenous communities affected by Guatemala’s Pojom II and San Andrés dams have called on the Inter-American Development Bank to withdraw its investment in the mega-projects. A complaint filed before the Bank’s independent accountability mechanism explains how the serious social and environmental damages caused by the planning and construction of the dams resulted from the projects’ failure to comply with the Bank’s operational policies. The communities are represented by the Interamerican Association for Environmental Defense (AIDA), the International Platform Against Impunity, and the Plurinational Ancestral Government of Q’anjob’al, Popti, Chuj and Akateko. “The damages caused by the projects’ implementation are the result of non-compliance with the Bank’s operational policies, particularly its policies on environment and sustainability, indigenous people, gender, and information disclosure,” explained Liliana Ávila, AIDA attorney. The complaint details how the dams were authorized without adequate community consultation, and how those affected did not receive sufficient information on the risks. In addition, community members who have peacefully resisted the projects have suffered attacks, threats, and harassment; in 2017, they reported the murder of one local resident, which has yet to be resolved. The construction of the dams has also caused severe environmental damage, including water scarcity and pollution, which have affected local people’s ability to fish, grow food, and maintain their tradition lifestyle. The affected people of the microregion of Ixquisis, in the department of Huehuetenango, are primarily indigenous Mayans including the Chu, Q’anjob’al and Akateko ethnic groups. “The damages from the dams are differentially suffered by women, since they are the primary managers of water use in their homes,” said Anabella Sibrián from the International Platform Against Impunity. “The women of Ixquisis face stigmatization and live in fear of retaliation for their peaceful opposition to the projects.” The Pojom II hydroelectric plant is operated by Generadora San Mateo S.A, while San Andrés is run by Generadora San Andrés S.A. Both are subsidiaries of Promoción y Desarrollos Hídricos S.A., a Guatemalan company.  In 2013, IDB Invest, a private arm of the Inter-American Development Bank, approved loans of up to $9 million USD for the construction of Pojom II and up to $6 million USD for the San Andrés project. “We our hope that the Bank’s accountability mechanism confirms the projects have violated internal policies and thus recommends that IDB Invest withdraw its investment from these harmful mega-dams,” Ávila said. Why Brazil must respond for Belo Monte's human rights violations

We did it! We’re proud to say we recently submitted the final arguments in our case against Brazil before the Inter-American Commission on Human Rights. In them, we demonstrate the damages Belo Monte has caused to indigenous and traditional communities, and residents of Altamira, the city closest to the dam. We’re working for them—to bring the government of Brazil to justice. “Human rights violations are a daily occurrence for those of us affected by the dam,” explained Antônia Melo, coordinator of the Movimento Xingu Vivo para Sempre, a citizens’ collective formed in the face of the dam’s implementation. “It’s urgent that our petition before the Commission advance to sanction the government and guarantee our rights.” We argue that the damages to local communities resulted from a severe lack of foresight and inadequate evaluation, as well as from failure to comply with the conditions for operation established by the government. The many risks denounced prior to the dam’s construction have since become long-term damages—many of which have affected men and women, and youth and the elderly, in different ways. Our report documents the displacement of indigenous and traditional communities forced to leave their territories without adequate alternatives, placing their cultural survival at risk. Among the affected populations are communities dedicated to fishing, who have not yet been compensated for the loss of livelihood. The dam has caused mass die-offs of fish and, although authorities have imposed millions in fines, the report demonstrates that the underlying problem has not been resolved. Local communities now have limited use of the Xingu River as a source of food, sustenance, transportation and entertainment. We have also noted—among other serious harms—the disappearance of traditional trades, such as brickmakers and cart drivers, and of traditional cultural practices. Women, for example, have stopped giving birth in their homes and must now go to a hospital, a reality that has drastically worsened due to the oversaturation of health and education services in Altamira caused by the recent population surge. Our case is now in the hands of the Commission. They will prepare their own report, concluding whether or not human rights violations occurred as a result of the Belo Monte Dam. If violations did occur, they may issue recommendations for remediation. If Brazil fails to respond, the case may be referred to the Inter-American Court on Human Rights, which has the power to issue a ruling condemning Brazil. The completion of this report brings us—and, more importantly, the communities we represent—one big step closer to achieving justice for the many wrongs committed in the name of the Belo Monte Dam, and energy development in the Amazon.

The women defending Guatemala’s rivers from large dams

When Maria gets up each morning, the first thing she does is open the tap in her house to see if there’s any water. If there is, she prepares coffee and, within a few hours, food for her family. Her house is alive with plants and animals. Dogs, cats and chickens surround her as she lights the wood stove, carrying her young son on her back. Maria lives in Ixquisis, a region of northwestern Guatemala near the Mexican border, in the department of Huehuetenango. There, water springs from the earth and large rivers like the Pojom and the Negro flow through the mountains. For Maria, the river is a special place. There, she meets with other women and washes clothes, a traditional activity for women in her community, most of whom are indigenous. Each afternoon, as the water flows steadily downstream, they talk about their families, their to-do lists, their joys and their worries. Last month, Maria joined with the other women of Ixquisis to speak about the threats the dams pose to their way of life.  They were part of a workshop AIDA organized in collaboration with Protection International and the International Platform Against Impunity. Maria’s life has changed a lot since they started building the Pojom II and San Andrés dams, and she’s been losing sleep. Before the construction of the dams began, Maria used to fish. By submerging a basket in the river, she gathered—as if by magic—snails, shrimp and small fish. These are riches the river no longer provides. Instead, the once pristine river has become filled with garbage, rubble and other debris. The workers use its water to wash cars and machinery. “One day we will run out of water and we won’t be able to live,” Maria said, echoing the primary fear of the women of Ixquisis. “Our children will suffer.” Their fear is well founded. Many families like Maria’s already suffer from stomach and skin diseases that they associate with water pollution. Before the workshop, the women of Ixquisis hadn’t had the opportunity to speak publicly about the importance of water and the rivers in their lives. They hadn’t been able to explain how their rivers had changed since the dams’ construction began. They had also never been provided with information about the projects. But even without knowing the details of the dams, Maria and her neighbors understood that the water in their homes no longer arrived as cleanly or as regularly as before. Time and again, they have peacefully expressed their opposition to the dams. But their voices have been stigmatized and shaken by fear of reprisal. Before Maria walked calmly through her community, even at night. She now leaves the house in fear. But the people of Ixquisis have the support of people and organizations that work to protect the environment and human rights. The international organization Front Line Defenders, for example, recently awarded them the 2018 Award for Human Rights Defenders at Risk.  One day after the women’s workshop, we organized a second meeting attended by the men of the region. The lack of water has affected their main subsistence activity: the cultivation of bananas, cardamom, vegetables and other products they take to market. Because their harvests have decreased, they must now work more hours to obtain the same profit. I learned a lot from Maria. Her strength, as well as that of all the residents of Ixquisis, comes from her respect for nature and all it offers them. I share that feeling and channel it into my work as an AIDA attorney, legally advising the men and women of Ixquisis on how to defend their territory. I work so that water will continue to flow from their taps, and so that they can one day walk again without fear, in search of a healthier future for their children.
