Barragem de Belo Monte no rio Xingu: 10 anos de impactos na Amazônia e de busca por reparações

A usina hidrelétrica de Belo Monte causou um desastre ambiental e social no coração da Amazônia: um dos ecossistemas mais importantes do planeta.

Essa situação só piorou desde que a usina começou a operar em 2016. A busca por justiça e reparação para as comunidades indígenas e ribeirinhas afetadas continua até hoje.

Em 2011, a Comissão Interamericana de Direitos Humanos (CIDH) concedeu a essas comunidades medidas de proteção, que até hoje não foram totalmente implementadas pelo Estado brasileiro.

E, desde junho daquele mesmo ano, a CIDH mantém um processo contra o Estado por sua responsabilidade internacional no caso.

A CIDH pode encaminhar o caso à Corte Interamericana de Direitos Humanos, que tem o poder de emitir uma sentença condenatória contra o Estado brasileiro.

Contexto

A usina hidrelétrica de Belo Monte — a quarta maior do mundo em capacidade instalada (11.233 MW) — foi construída no rio Xingu, no estado do Pará, norte do Brasil.

Foi inaugurada em 5 de maio de 2016, com uma única turbina. Naquela época, 80% do curso do rio foi desviado e 516 km² de terra foram inundados, uma área maior que a cidade de Chicago. Desse total, 400 km² eram de mata nativa. A usina começou a operar em plena capacidade em novembro de 2019.

Belo Monte foi construída e é operada pelo consórcio Norte Energia S.A., composto principalmente por empresas estatais. Foi financiada pelo Banco Nacional de Desenvolvimento Econômico e Social (BNDES), que aportou ao consórcio 25,4 bilhões de reais (aproximadamente US$ 10,16 bilhões), o maior investimento de sua história. Portanto, o BNDES também é legalmente responsável pelos impactos socioambientais associados ao projeto hidrelétrico.

Décadas de danos ambientais e humanos

As violações dos direitos humanos e a degradação da Amazônia remontam ao início do projeto. Em março de 2011, a Norte Energia iniciou a construção da barragem sem consulta adequada e sem o consentimento prévio, livre e informado das comunidades afetadas.

A construção levou ao deslocamento forçado de mais de 40.000 pessoas, rompendo laços sociais e culturais. O plano de reassentamento em Altamira — cidade diretamente afetada pelo projeto hidrelétrico — incluía moradias na periferia da cidade, sem serviços públicos adequados, moradias dignas para as famílias reassentadas e moradias diferenciadas para aqueles pertencentes a comunidades indígenas.

A operação da barragem de Belo Monte impôs uma seca permanente e artificial na Volta Grande do rio Xingu, agravada pelas secas históricas na Amazônia em 2023 e 2024. Como resultado, a morte de milhões de ovos de peixe foi documentada por quatro anos consecutivos (de 2021 a 2024) e, nos últimos três anos, não houve migração de peixes rio acima para desovar e se reproduzir. Assim, a pesca artesanal, principal fonte de proteína para os povos indígenas e comunidades ribeirinhas, foi severamente afetada: o consumo de peixe caiu de 50% para 30% do total de proteínas consumidas, sendo substituído por alimentos processados. Em suma, houve um colapso ambiental e humanitário que resultou no colapso da pesca como modo de vida tradicional, insegurança alimentar e falta de acesso à água potável para milhares de famílias, empobrecimento e doenças.

Além disso, a construção da barragem aumentou o desmatamento e intensificou a extração ilegal de madeira e a insegurança em terras indígenas e tribais, colocando em risco a sobrevivência dessas comunidades. Outra consequência foi o agravamento da pobreza e dos conflitos sociais, bem como a sobrecarga dos sistemas de saúde, educação e segurança pública em Altamira, cidade considerada a mais violenta do país em 2017, onde houve aumento do tráfico de pessoas e da violência sexual. Também foram registrados casos de violência contra defensores de direitos humanos envolvidos no caso.

Em 2025, durante a 30ª Conferência das Nações Unidas sobre Mudanças Climáticas (COP30), realizada no Brasil, o Ministério Público Federal classificou os danos causados ​​por Belo Monte como ecocídio.

A busca por justiça e reparação

Ao longo dos anos, o Ministério Público Federal do Pará, a Defensoria Pública e organizações da sociedade civil impetraram dezenas de ações judiciais em tribunais brasileiros para contestar as diversas irregularidades do projeto, bem como seus impactos. A maioria das ações permanece sem solução, algumas há mais de 10 anos.

Essas ações não obtiveram sucesso porque o governo federal tem reiteradamente anulado decisões favoráveis ​​às comunidades afetadas, recorrendo a um mecanismo pelo qual o presidente do Supremo Tribunal Federal pode suspender uma decisão judicial com base unicamente em argumentos genéricos como "interesse nacional" ou "ordem econômica".

Diante da falta de respostas eficazes em nível nacional, a AIDA — juntamente com uma coalizão de organizações aliadas — levou o caso à Comissão Interamericana de Direitos Humanos (CIDH) e, em 2010, solicitou medidas cautelares para proteger a vida, a integridade e a saúde das comunidades indígenas afetadas.

Em 1º de abril de 2011, a CIDH concedeu essas medidas e solicitou ao Estado brasileiro a suspensão das licenças ambientais e de quaisquer obras de construção até que as condições relativas à consulta prévia e à proteção da saúde e integridade das comunidades fossem atendidas.

E, em 16 de junho de 2011, apresentamos uma denúncia formal à CIDH — juntamente com o Movimento Xingu Vivo Para Siempre, a Coordenação das Organizações Indígenas da Amazônia Brasileira, a Diocese de Altamira, o Conselho Missionário Indígena, a Sociedade Pará de Defesa dos Direitos Humanos e a Global Justice — contra o Estado brasileiro por sua responsabilidade internacional nas violações de direitos humanos contra os povos afetados neste caso. A denúncia foi apresentada em dezembro de 2015.

Em 3 de agosto de 2011, a CIDH modificou as medidas cautelares para solicitar — em vez da suspensão de licenças e obras — a proteção dos povos que vivem em isolamento voluntário, a saúde das comunidades indígenas e a regularização e proteção das terras ancestrais.

Situação atual

As medidas de proteção concedidas pela CIDH permanecem em vigor, mas o Estado brasileiro não as cumpriu integralmente, relatando apenas ações genéricas. As comunidades documentaram as contínuas violações de seus direitos. A situação que motivou o pedido dessas medidas — o risco à vida, à segurança e aos meios de subsistência das comunidades — persiste e se agravou com a usina hidrelétrica operando em plena capacidade e com as recentes secas extremas na Amazônia.

Além do ocorrido em Belo Monte, existe o risco de maiores danos sociais e ambientais decorrentes da implementação de outro megaprojeto de mineração na Volta Grande do Xingu. Lá, a empresa canadense Belo Sun pretende construir a maior mina de ouro a céu aberto do Brasil.

Os impactos sinérgicos e cumulativos da usina e da mina não foram avaliados. O Estado excluiu povos indígenas, comunidades ribeirinhas e comunidades camponesas do processo de licenciamento ambiental do projeto. Apesar disso, dos protestos indígenas e de outras irregularidades em torno do projeto, o governo do estado do Pará autorizou formalmente a mina em abril de 2026.

Belo Monte, assim como outras usinas hidrelétricas, agrava a emergência climática ao gerar emissões de gases de efeito estufa em seu reservatório. Além disso, é ineficiente diante das secas prolongadas e intensas causadas pela crise, pois perde capacidade de geração de energia.

O caso perante a Comissão Interamericana

Em outubro de 2017, a CIDH anunciou que decidiria conjuntamente sobre a admissibilidade (se o caso preenche os requisitos para admissão) e o mérito (se houve, de fato, violação de direitos humanos) da denúncia internacional contra o Estado brasileiro.

Quinze anos após a apresentação da denúncia, as comunidades afetadas e as organizações que as representam ainda aguardam essa decisão. Caso a CIDH conclua que houve violações de direitos humanos e emita recomendações que o Estado brasileiro não cumpra, poderá encaminhar o caso à Corte Interamericana de Direitos Humanos, cujas decisões são vinculativas.

Uma possível decisão da Corte Internacional de Direitos Humanos neste caso estabeleceria um precedente jurídico regional em relação aos direitos dos povos indígenas e ribeirinhos, à participação pública em megaprojetos e à responsabilidade do Estado no contexto da crise climática. Isso é particularmente relevante à luz do Parecer Consultivo nº 32 da Corte, que reafirmou as obrigações dos Estados de proteger pessoas e comunidades em todo o continente da emergência climática.

Organizations request Mexico list parrotfish as protected species

Parrotfish are vital to the health of coral reefs, and the Mexican State has an obligation to protect them. In a letter to the government, AIDA outlined the international obligations Mexico has to preserve its coral reefs, requesting that ten species of parrotfish be included in the nation’s list of protected species—a proposal spearheaded by the Healthy Reefs Initiative.   Mexico City. Using arguments based in international law and knowledge of environmental treaties, the Interamerican Association for Environmental Defense (AIDA) requested that the Mexican government include ten species of parrotfish in the national registry of protected species, under Official Mexican Law 059, which is currently being updated. AIDA made the request through a letter to the National Advisory Committee for the Normalization of the Environment and Natural Resources, in support of a proposal the Healthy Reefs for Healthy People Initiative made in September in coordination with Casa Wayuu, the Kanan Kay Alliance and the Mexican Center for Environmental Law (CEMDA). “The species of parrotfish we are trying to protect play a vital role in the survival of coral reefs because they feed on algae which otherwise deprive the coral of light and oxygen,” said AIDA attorney Camilo Thomson. “Populations of these fish have declined drastically due to habitat degradation, pollution and climate change. Studies done by the Health Reefs Initiative, among others, have shown that 60 percent of the coral reefs in the Mexican Caribbean are in either poor or critical condition.” The organizations are calling for the following species to be listed under some category of risk in Official Mexican Law 059: the stoplight parrotfish (Sparisoma viride), the rainbow parrotfish (Scarus guacamaia), the blue parrotfish (Scarus coeruleus), the midnight parrotfish (Scarus coelestinus), the queen parrotfish (Scarus vetula), the princess parrotfish (Scarus taeniopterus), the striped parrotfish (Scarus iseri), the redband parrotfish (Sparisoma aurofrenatum), the redtail parrotfish (Sparisoma rubipinne), and the yellowtail parrotfish (Sparisoma chrysopterum). The letter outlines the treaties and conventions that oblige the Mexican State to adequately fight threats to species requiring special protection—species like herbivorous fish, which are vital for the health of Caribbean reefs and other marine ecosystems. These agreements include the Convention for the Protection and Development of the Marine Environment in the Wider Caribbean Region (also known as the Cartagena Convention), the United Nations Convention on the Law of the Sea, the Convention on Biological Diversity, the Ramsar Convention, the Convention concerning the Protection of World Cultural and Natural Heritage, the Tulum Declaration, and the International Coral Reef Initiative. “The letter also mentions the Advisory Opinion on human rights and the environment issued by the Inter-American Court of Human Rights,” Thomson added. “In that decision, the Court strengthens States’ obligations to protect human rights and acknowledges the close relationship that has with environmental protection.” Despite serving as fish hatcheries and natural barriers against hurricanes—among other key functions—coral reefs are very fragile and vulnerable to climate change, the consequences of which include ocean acidification, sea level rise and algal blooms. The latter are caused by untreated or inadequately treated wastewater being pumped into the Caribbean, and other forms of marine pollution. “The most recent report from the Intergovernmental Panel on Climate Change (IPCC) warned that the warming of the planet’s average temperature by more than 1.5 degrees Celsius would result in the destruction of reefs,” explained Melina Soto, Mexico coordinator for the Healthy Reefs Initiative. “It is therefore urgent States adopt adequate measures to preserve coral reefs, and one way to do that is through the protection of herbivorous fish.” Find more information about the case here. Civil society warns Inter-American Commission of human rights violations caused by fracking in Latin America

Boulder, Colorado. Representatives of communities and organizations from across Latin America testified before the Inter-American Commission on Human Rights this week on the impacts that hydraulic fracturing (fracking) has on human rights and the environment. The hearing—responding to a petition signed by more than 126 organizations from 11 countries of the Americas—was held in Boulder, Colorado this week as part of the Commission’s 169th period of sessions. The principal requests to the Commission, and the Rapporteurs from various countries, were to urge the States to adopt efficient and opportune measures to prevent human rights violations resulting from the exploration and exploitation of hydrocarbons, and to apply the precautionary principal in the face of fracking’s environmental damages. “In Latin America, fracking been carried out without informing or adequately consulting the affected populations, thereby violating their right to information, participation, prior consultation and consent,” explained Liliana Ávila, Senior Attorney with the Interamerican Association for Environmental Defense (AIDA). “Fracking’s demand for water competes with the use of water for human consumption, and the contamination it causes in the water, soil and air seriously impacts the right to a healthy environment and compromises the effective enjoyment of other rights—including a dignified life, personal integrity, health, food, water and adequate housing.” At the hearing, it was emphasized that women disproportionately suffer the impacts of fracking due to potential harm to their reproductive health, and since women are traditionally responsible for collecting water for use in their homes.   Referring to the experience of the Mapuche communities of Argentina, Santiago Cané of the Environment and Natural Resources Foundation (FARN) stressed, “Fracking produces acts of violence against those who defend the environment and their rights.” “Institutionally, we can talk about the criminalization of social protest as one form of intimidation to eliminate the resistance to fracking projects,” he explained. “The prosecution of criminal cases against communities leaders that oppose the development of fracking has become an institutional media campaign that seeks to promote the idea that Mapuche communities are part of a terrorist group.” In Mexico, “specifically in the municipality of Papantla, Veracruz—which according to freedom of information requests is the city with the greatest number of fracking pools in the country—where the population is primarily the Totonac people, this exploitation technique has led to the diversion of springs and the drying up of artisanal wells. Many communities have lost their natural sources of water and have seen their health compromised and their living conditions deteriorate,” explained Alejandra Jiménez of the Mexican Alliance Against Fracking. Dorys Gutiérrez, of the Colombian organization Corporation for the Defense of Water, Territory and Ecosystems, noted that: “In Europe, 18 nations have applied the precautionary principle to prohibit or restrict this practice and in Australia, four of the eight territories have bans or moratoria in place. If fracking is so beneficial, why has it been so widely rejected in so many places?” According to data compiled by the Latin American Alliance on Fracking, roughly 5,000 fracking wells exist across the region. About 2,000 of those wells are found in Argentina; more than 3,350 are found in Mexico; and in Chile, according to official data, 182 wells have been approved, primarily for the island of Tierra del Fuego. Despite the technique’s expansion across the region, there has also been progress in banning or imposing restrictions on fracking in three states of the United States, in Uruguay, in the Argentine province of Entre Ríos, and in more than 300 municipalities in Brazil. Fracking’s advance is harmful to human rights, and represents a threat to the consolidation of the legal framework promoted by the Inter-American Human Rights System, which includes the obligations of States and the international protection of human rights and the environment. Say no to large dams: 3 reasons to opt for alternative energy sources

By Florencia Ortúzar and Monti Aguirre* Hydroelectric energy has been one of the largest drivers of development in many Latin American nations, and still represents a large portion of the region’s energy matrix. But is it really the best option? In response to a blog by the Inter-American Development Bank reflecting on the future of the hydroelectric sector in Latin America, we’d like to reflect on what it means to continue betting on large dams in Latin America. What follows are three reasons why we must say no to more large dams: 1. Better alternatives to hydroelectricity exist, and should be considered in project planning Before selecting an alternative energy source, governments and companies should develop a strategic plan that analyzes energy needs and the best way of achieving them. In this analysis, all options must be considered. It’s worrysome that this doesn’t already happen. For example, in the case of the Hidroituango dam—thought to be the largest in Colombia and associated with serious socio-environmental damages—the government decided to not conduct a prior evaluation of alternatives. Although the law did not require it at the time, the evaluation was recommended and is an international standard that large financial institutions should apply when investing in projects of this type. Today, other energy sources—like wind and solar—are proven to be economically competitive, can be constructed more quickly, and do not aggravate climate change. Innovations in smart grids, power storage and batteries also solve intermittency problems and make hydroelectric plants unnecessary. Geothermal, tidal, and wave energy are alternatives, the potential of which we have not even glimpsed. The promotion of large dams only delays adoption of the truly clean energy solutions that Latin America and the planet desperately need. According to the Bank’s own studies, Latin America has the largest quantity and most varied sources of renewable energy in the world. The region's renewable resources could provide almost seven times the installed capacity worldwide, excluding hydroelectric power. Therefore, although the region still holds great potential for untapped hydroelectric power, it’s necessary to conduct a comprehensive evaluation of the situation, taking into account the costs and benefits as compared to other energy options. Only then can governments decide whether it’s worth continuing to invest in hydropower, or whether it’s better to opt for other types of energy—thus avoiding the social, environmental and financial impacts that come with large dams. 2. Large dams cause socio-environmental damage and are not profitable It has been demonstrated repeatedly that the socio-environmental impacts of hydroelectric plants are greater than initially considered. In addition to forced displacement and the criminalization of those who oppose them, large dams flood land, reduce river flows, and change the ecosystems of downstream wetlands, destroying habitats and contributing to species extinction. All this impacts the lives of nearby communities, limiting their ability to adapt to climate change. In economic terms, a study by the University of Oxford concluded that “even before accounting for the negative impacts on human society and environment, the actual construction costs of large dams are too high to yield a positive return.” In it, researchers show that the budgets and timeframes of large dam projects are consistently underestimated. Brazil’s Belo Monte Dam, for example, ran two times over its original budget, making it the most expensive public works project in the Amazon region. The budget of Chile’s Alto Maipo Dam has doubled four times over since the project was approved in 2009. Recognizing that the costs far outweigh the benefits, some countries have opted for dismantling large dams. And private companies have scrapped hydroelectric projects altogether because they are neither economically viable nor profitable. The United States government  has adopted a policy to refuse any loan, donation, strategy or policy supporting the construction of large dams. 3. Large dams contribute to climate change Climate change must be considered when discussing the relevance of hydroelectricity. Reservoirs generate significant quantities of greenhouse gases, particularly methane, which is 30 times more effective at trapping heat than carbon dioxide. Likewise, the construction of dams endangers valuable carbon sinks like rivers and forests. For that reason, a proper analysis of carbon dioxide and methane emissions should be conducted before choosing a dam project—a process that usually doesn't occur. Another aspect to consider is the vulnerability of dams to climate variations. Extreme rainfall increases sedimentation, which can cause structural problems and reduce the dam's lifespan. Droughts, now increasingly frequent, can render dams inefficient. As more dams lose efficiency, Latin America—now highly dependent on hydroelectricity—will be more vulnerable to energy shortages. Even more serious is the threat posed by large dams in extreme weather events. In a dam gave way during bad weather, erasing entire villages. In Laos earlier this year, mass evacuations were ordered after heavy rains threatened a dam collapse. In Kerala, India, torrential rains, coupled with the mismanagement of several dams, have caused unprecedented flooding. In certain countries, the risk of dams overflowing or collapsing has already been recognized as a serious problem. Over time, more hydroelectric plants will begin to deteriorate and will require large investments to safeguard the communities living downstream. As civil society representatives working for a more just and sustainable Latin America, we urge financial institutions like the Inter-American Development Bank to support the change we as a region need. We call on them to stop investing in large dams, which have been demonstrated time and again to be dangerous to the environment and local communities, costly for countries, and unsuited for our rapidly changing climate. It’s time for a better energy plan. And it’s time to invest in non-conventional renewable energy based on thorough, independent and high-quality social and environmental impact assessments, the planning and implementation of which respect human rights. * Monti Aguirre is the Latin America Program Coordinator for International Rivers.
